Week 3 Discussion 1 Title Vll of the Civil Rights Act of 1964 Under Title VII, a hostile work environment exists when the workplace is "permeated with discriminatory, intimidation, ridicule, and insult, that is sufficiently severe or pervasive to alter the conditions of the victim's employment and create an abusive working environment." evidence of sexual harassment is sufficient to show a hostile work environment.  (Legal Information Institute 2023) Title VII also imposes an obligation to employers to reasonably accommodate employees, such as leaves for religious observance or practice. The standard for such accommodations is a reasonable one, and the employer may refute accommodations that impose undue hardship on the employer's business. Noted that the Supreme Court has held that unpaid leave for religious absences constitutes reasonable accommodation to refute a claim under Title VII. However, it is also noted that unpaid leave would not be reasonable accommodation if paid leave is provided for all purposes except religious ones. (Legal Information Institute 2023) Title VII is not the exclusive authority on employment discrimination law. Indeed, the Equal Pay Act (EPA) is another federal employment law giving employees a private right to action for discriminatory pay. However, Title VII cover types of wage discrimination not actionable under the EPA. A plaintiff may bring a claim under both the EPA and title VII so long as the plaintiff does not receive duplicative relief. (Legal Information Institute 2023) Moreover, many states have their own employment discrimination laws. We see in New York, the Human Rights Law prohibits employers from refusing employment or fair compensation because of (among other characteristics) race, creed, color, national origin. Title VII does not preempt such state laws so long as they do not allow for acts that would be illegal under Title VII. As a result, state laws may supplement and even cover some shortcomings of Title VII. Week 3 Discussion 2 Week 3 Discussion 2: Are You Ready to Take and Pass Your HRCI Exam? Discuss the areas in the Exam Content Outlines that have been studied thus far and identify what areas you have been challenged most in learning. Why? What other study strategies could you employ to support your learning in these content areas? I have a great deal of experience in HR, and I have been studying the outline for about four months. So far, I have been lucky and have not found any area really challenging. Just remembering the dates on the laws can be somewhat of challenging at times. The reason I don’t find many areas challenging is that if you work in it everyday you use your work experience with what you study. The other study things I do, I take the HRCP flash cards, and my wife reads me the questions on the front of the cards example (Blue Book (1) and I will give her the answer as we travel to and back from our cabin in The Smokey Mountains. This gives me three hours of study time each way of our weekends away from home. I would recommend the following: A. Assess your strengths and weaknesses in HR competency areas and create a study plan accordingly. B. Gather your resources, such as review books, blogs, articles, podcasts, and practice exams. C. Immerse yourself in strategic HR topics and learn from senior HR professionals. D. Study and take practice exams regularly, but limit studying the night before the exam. E. Rest well, eat healthily, and dress comfortably on the exam day. Although the SPHR exam is not like other exams, there are still strategic ways to approach each question and solution. While typical exams tend to test for IQ levels or amounts of information retained, the SPHR exam is testing your HR experience by presenting everyday HR dilemmas for you to solve. Skimming through questions, quickly selecting the multiple choice answer that best fits, or going with your gut instinct and choosing the first answer that pops into your mind won't work here. Toss out your preconceived notions of test-taking strategies and gear up for a new kind of approach. I do feel I could pass the SPHR exam today.
