Strain theory and New Deviancy Theory (NDT) are mirror images of those above. Strain theory understands human nature to be socially constructed, where, committing a crime is produced by society not from individual instincts, favouring a deterministic perspective but also recognising that individuals rationalise from inside their determined position to achieve their aspirations. However, methods of innovation, ritualism, retreatism, or rebellion are not included under human rationality. Combining voluntaristic and determinacy is a main feature in NDT, although, they argue that while individuals are born free, they lose their agency in societal frameworks that manage behaviour; the state. The problem with this is that it ignores class conflict and therefore denies the basic causes of crime.

The concept of ‘crime’ is something that depends on time, place, and other influences. For this reason, researchers have been trying to get criminologists to rethink their definitions of ‘crime’ and consider the idea of ‘social harm’ which could help better explain the causes of human suffering and the definitions of ‘crime’ and ‘criminals’ and broaden the application of criminal justice. What this rethinking can do for criminologists broadly is give them a broader picture of human psychology as well as the range of harms that individuals, communities, or whole societies experience. In this context this can include crime in the sense of activities of individuals as well as government and institutions.

This essay will discuss the strengths and weaknesses of sociological explanations of crimes with links to Durkheim’s anomie theory, Merton’s strain theory and the Labelling theory which will draw upon different academics that will highlight these specific areas of research. In sociological terms, crime is a social concept as it does not exist as an autonomous entity, but it is socially constructed by people. It can be analysed that sociological explanations of crime attribute deviance to various aspects of the social environment. For example, crime is strongly related to modern city life where this type of social environment creates cultural enclaves which results in producing criminal or deviant behaviour (Carrabine et al, 2014).

Criminology is the definition of our crime today, it defines many aspects and elements that challenge our common sense understanding of crime. The term ‘Criminology’ was first introduced into the English language in Garland 1988 by a criminologist Havelock Ellis (jones, 2013, pp. 2-3). However criminology was present in the 1860’s as Henry Maudsley a medic that worked in the prison systems to study insane and feeble - minded criminals (jones, 2013, pp. 2.) Criminology gives an understanding to those that seek justice although some victims may prevent crime or encourage it to gain the same significance. The reasoning of crime has changed considerably over the past 40 years, some say it was the change of the criminal justice system abolishing Capital punishment in 1965, or just the development in different legislations. Making punishment more psychological rather than physical punishment may have increased the velocity of the crime rate today as some may argue it is less harsh. The modern societies around the world put a high importance on preventing criminal activity and rectifying behavior that leads to crime. In an ongoing struggle against corruption, many sociologists, and psychologists have done in-depth research to understand what is the cause of crime in our society. Initially, in 1893, Emile Durkheim first came up with the idea called Anomie Theory to explain why offenses take place in our communities. Durkheim reported that crimes took place in our society because there was a lack of ethical norms and social standards within our communities (Walsh, 2018).However, almost half a century later, Robert K. Merton developed Merton's Strain Theory to thoroughly explain why some people in our society are more likely to commit crimes than the others who don’t. Merton’s Strain Theory argues that corruption not only occurs in our communities because we lack norms in our society, but are also caused by the strains that are present among us as individuals which influence people to commit the crime. In his explanation, people will resort to achieving success through illegitimate means when they are blocked from acquiring success through legitimate means (Walsh, 2018). During the 1970’s to the early 1990’s there had emerged two new approaches to the study of crime and deviance. The discipline of criminology had expanded further introducing right and left realism, both believe in different areas and came together in order to try and get a better understanding on crime and prevention. There were many theorists that had influenced the realism approaches such as; Jock Young (Left Wing) and James Wilson (Right Wing).

The legal definition of crime is “an act of violation of a criminal law for which a punishment is prescribed; the person committing it must have intended to do so and must have done so without legally acceptable defence or justification” (Walsh & Hemmens 2008:2). Alternatively, deviance is any social behaviour which departs from that regarded as ‘normal’ or socially acceptable within a society or social context (Jary & Jary 1991:160). The underlining focus of my essay is The Criminal Justice System in England and Wales which is a key public service consisting of various bodies and individuals including: the Police, Crown Prosecution Service, Her Majesty’s Court Service, National Offender Management Services (Probation and Prisons) and Youth Justice Board.

In the 1950’s, Cohen (1955) took Merton’s theory of crime further by focusing on gang delinquency within the working class demographic. Cohen used the central idea of the anomie theory but narrowed its focus on this particular subculture and elaborated it in order to explain the characteristics of gang delinquency.

Crime is the product of the social structure; it is embedded in the very fibres of society. In this essay, I aim to explore different theories as to why crime exists within society and how we as a society therefore construct it. Crime is a social construct; it is always in society and is on the increase. It is inevitable. Where does it come from? It comes from legislation, from the making of laws.

Visibility in school wasn’t any different, the Saints unlike the Roughnecks were able to get out of class, due to their clean “good boy” perceptions. Additionally, the Roughnecks, drew even more attention to themselves as they frequently made remarks to people passing by. Secondly, the demeanor of both gangs were complete opposites of each other, if one of the Saints was stopped by a police officer, his “demeanor was apologetic and penitent” (Chambliss, 2011, pg. 192). On the contrary, Roughnecks, didn’t have much respect for authority, and their animosity, enmity, and aggression was clearly obvious. Finally, society members, perceived the delinquent acts of the Saints less serious than delinquent acts of the Roughnecks. In their view, someone who showcases public drunkenness is committing a more serious crime than someone who drinks in bar.

Introduction: Throughout history there have always been many different theories of crime and why people commit crimes. In the late 1930s a new theory rose to the forefront; this theory was called the anomie theory. Anomie means a lack of ethical standards. The anomie theory was proposed by Roberton Merton. It stated that society, as a whole, generally shares the same goals relating to having success in life; whether that is having a family, wealth, power, or just happiness. Society generally agrees that these are things that are to be sought after. Furthermore, Merton proposed that society, as a whole, also has a list of generally accepted ways to achieve such goals (Merton, 1938). Criminal activity, such as robbery, murder, and corruption, are among the things that are not accepted by society as appropriate means to achieve these goals. Merton’s anomie theory was built upon in 1992 by Robert Agnew who developed the general strain theory. General strain theory argues that when members of society are unable to achieve the general goals that society has set forth, they will, in order to avoid further rejection, further alienate themselves from society. Merton’s Anomie Theory believes that society shapes the cultural norms and values of people and also their aspirations and the approved methods of achieving such aspirations. Merton considers that there is a link between anomie in society and the difference between the levels of emphasis placed on aspirations and those placed on the means of realizing these aspirations in society; the smaller the difference the less likely anomie will occur. Merton also believes that crime is caused by society although he believes it is not useful to society; Merton believes that crime is a representation of the poor organization of society. In American culture, monetary success is the predominant cultural goal, but not everyone has the same access to attain it. Some people respond to this disjunction in criminal ways. Components of adaptation to strain include conformity which is when people embrace conventional social goals and also have the means to attain them, they can choose to conform. They remain law-abiding.
