A Harbinger Of Danger And Discontent

Modern Americans see privacy as one of the greatest freedoms. When Edward Snowden revealed the NSA surveillance program, the citizens of the United States were appalled by the extent of access the NSA had to personal information. However, according to Dan Tapscott in his essay, “Should We Ditch the Idea of Privacy?” we post just as many details daily on our numerous social media outlets. The majority of the information we freely post is not meaningful and does no harm to us by being public, yet there is a dangerous side to our open-book nature.

Since the time the framers of the constitution, technology has improved significantly which has led to an increasing concern in the privacy of an individual. Technology, used by government agencies and commercial enterprises, has led to a change in one’s privacy and freedom. For this reason, the agencies and enterprises have been called into question of infringement of the fourth. Using the lessons learned from history, the framers of the constitutions created the fourth amendment, which protects from unreasonable searches, and the fifth amendment, which prevents a person from incriminating himself or herself, to create a government with just laws, but with the advancement in technology, the fourth amendment needs to expand its policies to fit the changes in modern society.

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated…” Sound familiar? Well it should. That quote was a section of the Fourth Amendment to the United States Constitution. Those lines are one of the many things that set America apart from other countries around the world. It has protected us for centuries from “unreasonable searches and seizures…” made by anyone, including the government. This is all beginning to change with the inventions of the smartphone, computer, and even GPS. These inventions have possibly turned our world for the better, or maybe even for the worse.

The Fourth Amendment is an important part of our constitution and protecting U.S. citizens’ rights, but has recently been weakened and worm holed by the government. The amendment states that there has to be a search warrant issued in order to be able to gain access to a U.S. citizens personal records. Since the 60’s however, this rule has been bypassed to allow the NSA to have the ability to search homes and personal records without a search warrant. Modern technology has negatively effected the amendment, and has been one of the most recent cases of the amendment being worm holed. Privacy is what allows people to feel secure in their surroundings. With privacy, one is allowed to withhold or distribute the information they want by choice, but the ability to have that choice is being violated in today’s society. Benjamin Franklin once said, “He who sacrifices freedom or liberty will eventually have neither.” And that’s the unfortunate truth that is and has occurred in recent years. Privacy, especially in such a fast paced moving world, is extremely vital yet is extremely violated, as recently discovered the NSA has been spying on U.S. citizens for quite a while now; based on the Fourth Amendment, the risk of leaked and distorted individual information, as well as vulnerability to lack of anonymity.

He continues with people in the US started thinking about the legal right to privacy in the 1890, at the time when the Kodak camera was introduced and then gives several more examples of technology people have feared over the years. Jarvis fears that government regulations could restricts are ability to connect online and wonders “if Google can be told not to take pictures of public places, will citizens be censored next?” (430).
