Aiding In Racial Profiling

Since the birth of our nation, racial profiling has been an issue longstanding and troubling among minority groups and still continues to exhibit severe consequences in communities.

This paper outlines the studies, incidents, facts and statistics that have found evidence of racial profiling which causes distrust in the law enforcements (police, government etc0. Studies of racial profiling shows that blacks, Hispanics, Middle Eastern and other racial minorities are more likely to be stopped than those who are white. They are more likely to be stopped and searches, traffic stops, license and registration checks. In addition they are more likely to be ticketed or arrested after being stopped and search. Some scholars and studies believes that minorities being that are frequently stopped and searched has nothing to do with them being racially profiled. According to Roh and Robinson,” studies raise the possibility that minorities may be more involved in criminality (Gaines, 2006), some drug crimes (Lichtenberg, 2006), and speeding offenses (Lange, Johnson, & Voas, 2005), thereby justifying higher stop and arrest rates by police of some groups.” (Roh, S., & Robinson, M.)

Racial profiling remains a dormant issue in the United States. It is the act of the authority, mostly, police officers linking minority status to criminal behaviour (Glover, 2007). Several police officers in the United States target specific groups because they don’t display characteristics of typical Caucasian individuals (Glover, 2007). To put history into context, before 9/11, not many police officers profiled individuals based on their ethnic backgrounds but after the attack, there was an increase in racial profiling (Harris, 2006). A racial profiling method that became prevalent in the 1980s in the United States was administered by the U.S Drug Enforcement Administration. Operation Pipeline was a program that they launched to help police officers catch drug traffickers (Harris, 2006). In a video, they taught police officers to look for clues that would help them recognize criminals. It was noticed that police officers made a majority of stops to people with Hispanic last names (Harris, 2006). Marshall Frank, a former police officer was asked what police officers should do if they saw an African man driving around a white community. Frank responded by stating that the police officers should stop the vehicle and investigate the reason to why he was there even if there was no occurrence of a crime (Harris, 2006).

Racial profiling is simply, “the unlawful police practice of using race, color, or ethnic background, as the reason for conducting a traffic stop on an individual.” (Michigan Civil Rights Commission) This definition can be extended to any kind of discrimination mainly based on myths and stereotypes towards a certain race or ethnicity. However, the term racial profiling is commonly used when a police officer or any other law enforcer stops, questions, searches or arrests an individual purely on the basis of their race. African Americans or simply blacks have been the major racial group that has suffered much of racial profiling. Much of this is based on the stereotypes against the blacks are perceived as more likely to engage in criminal activities. For instance, in a 2013 Racial Profiling Data from Ferguson Police Department, out of 5384 police stops, 4632 were against blacks. (Ferguson Police Dept. 1) Despite the low population of blacks in U.S. compared to other races, the former continues being subjected to more racial profiling. Racial profiling against African Americans continues to expose the blacks to humiliation and racial injustices, as this paper will expose, thereby calling for the responsible authorities to address and find solutions for the problem.

One of the most imminent threats looming within American society is race relations. America is a melting pot of different races, cultures, and religions, yet the matter of racial profiling still remains prominent today. By definition it is considered “an activity carried out by enforcers of the law wherein they investigate or stop any individual in traffic or round up people of the same race or ethnicity for crime suspicion” (NYLN.org ). Racial profiling is still an ongoing issue that occurs and such an issue has led to many problems for the minority groups of this country. Whether it be African Americans, Indians, Asians, Mexicans, or Muslims, all have faced profiling at some point in time. The problems caused by this controversial subject include the impending distrust between black communities and law enforcement, unfair treatment towards all minorities by law enforcement, verbal and physical abuse of minorities by police officers which can sometimes lead to death, emotional unstableness of the victims whom have faced such a terrible judgement, and the negative impact it has on children of the minority groups.

Racial profiling in law enforcement is referenced when a law enforcement officer targets an individual for suspicion of a crime. A broader definition of racial profiling in law enforcements is when a law enforcement officer, uses an individual’s race or ethnicity, age , time of the day (usually later in the day), dress code and also location to accuse a person of a crime. In today’s world the term racial profiling can be viewed in various view points, because of people having different opinions on the term, many disagreements occur. Some people believe that specific incidents are not cases of racial profiling and others think otherwise, needless to say an argument occurs.

Over the last twenty years the issue of racial profiling has become extremely combative with regards to law enforcement practices. A common misconception begins as some people are unaware of what racial profiling actually is. Racial profiling typically deals with incarceration, miss education, and to certain extent slavery. The topic of slavery is relevant in the conversation of racial profiling because like slavery, African Americans have suffered just due their own identity. Profiling is essentially the selection of an individual and categorizing them due to a specific racial group. In today’s world we deal with multiple cases of racial profiling seemingly on a daily basis. Turn on the television, check the internet, or simply have a discussion with someone and you’ll hear about it. "Racial Profiling" describes discriminatory practices by law enforcement officials who target people for suspicion of crime based on their ethnicity, race, origin, or religion. The term first came about during the War on Drugs in the 1970’s and 1980’s when law enforcement were accused of pulling over motorists simply because of their race, then unlawfully searching their vehicles for illegal substances. There are varying opinions about this topic and as the year’s progress, it seems acts of racism, labeling, and profiling increase. Many of the instances of racial profiling that occur today involve criminal justice.

Even the United States struggles with issues of racial discrimination despite being a society highly based on immigrants and multicultural diversity. On one hand, people frown on treatment based on race, whether that is on an individual or group level. On the other, people are tired and annoyed by the seemingly constant call of discrimination. All of these feelings culminate into the debate pertaining to the use of racial profiling. Likewise, there are some individuals that hold a certain level of acceptance in regard to racial profiling. Racial profiling has been a recurring issue for quite a while in the history of America and it appears as if it will proceed the same. Many individuals do not know what racial profiling stands for and sometimes victims of racial profiling aren’t even aware of the meaning. Racial profiling is often identified as the use of race by any law pursuing organization to any extent, as a reason for unlawful conjecture in non-specific inspections. Every person is entitled to basic human freedoms and rights, which are undermined when discrimination based on religion, nationality, ethnicity, race, or other particular status occurs. It is unlawful to discriminate against citizens regardless of their race according to the United States Constitution, Civil Rights Act of 1964.

The concern about racial profiling is erupting throughout the nation. Many cities and states have decided to study racial profiling, or how race and ethnicity may play a part in traffic stops by law enforcement in their jurisdictions. There seems to be a generally accepted understanding of what profiling is. Profiling is the law-enforcement practice of scrutinizing certain individuals based on characteristics thought to indicate a likelihood of criminal behavior. Yet there are two variations concerning the application of racial profiling. Profiling either utilizes race as a sole means of directing police attention, or uses race as a part of a larger set of characteristics and behaviors that lead to police involvement (Chan, 2011, pg. 75). Regardless of the definition of racial profiling, the debate over racial profiling centers on two questions. Does racial profiling actually occur? and Is racial profiling being used and is profiling a legitimate tool of law enforcement?

The concept of racial profiling has its wide range of definitions. According to the American Civil Liberties Union, racial profiling means “the discriminatory practice by law enforcement officials of targeting individuals for suspicion of crime based on the individual 's race, ethnicity, religion or national origin.” In other words, racial profiling has its assumptions that particular individuals are more likely to be involved in transgression or unlawful activities based on individual’s race or background. Racial profiling does not just exist today; it thrives and mostly propels a brutalizing message and inhuman misconception to citizens of the United States whom they are pre-judged by the color of their skin. The primary cause of profiling is racism or race-related discrimination. Unfortunately, this unwarranted approach is now commonly used by law enforcement officers, even though it could be both unjust and unconstitutional. Not only does it violate the core principles of this country, but it can be dangerous and deadly because it threatens our privacy and security. It is also a threat to racial equality, where many influential and prominent people have fought for to accomplish. Although many heroic activist leaders have ended racial division to its certain extent, yet many African-Americans all over America still face the rigid unequal world because of unjustifiable race-related tragedies that tremendously affects African-Americans.

The fact remains that racial profiling began long ago before the excessive interaction seen on highways and city streets alike where minorities are principally stopped. This country has a history of profiling minorities, from the inhuman enslavement of millions of Africans during the institutionalization of slavery, to the unlawful imprisonment of Japanese Americans in concentration camps during World War II; minorities around the country have consistently been the targets of racial profiling. The problem is far deeper than just black and white; its roots lie at the economic, social, and political disparities that Anglo-Americans enjoy over minorities in this country. These disparities are a result of a system based on class status and monetary gain, two attributes enjoyed far more widely by the mainstream population than minorities (statistics about economic disparities b/ blacks and whites).

A major issue that has been at the forefront of the topic of race in America is racial profiling. This practice of targeting individuals based on the individual’s race is not new and has been in use for many many years. However it has recently come to national attention with the killing of unarmed black teenagers by police officers. The issue of racial profiling not only highlights the lack of equality in America but the issue of policemen using excessive force when dealing with criminal activity.
