Paul Haring, Colin Morgan, both male, both Caucasian
Summary: On September 18th 2014 Paul Haring was arrested for OWI and fleeing the scene of an accident. Colin Morgan was written up for MIP and released into his parent's custody. One witness was interviewed.
Information:
On September 18th 2014 at 14:02 a collision occurred in the parking lot of 2138 Sprinkle Road.
One of the vehicles involved pulled away from the accident and headed north on Sprinkle Road. Two witnesses called this in and gave a description of the vehicle. From this description the vehicle was pulled over on the corner of East Main Street and and 26th street at 14:07.

The PBT showed Haring having a BAC of 0.11.
Arrest:
At 14:32 Haring was arrested for OWI and fleeing the scene of an accident. He was taken away for booking and a Data Master Breathalyzer test.
Vehicle Disposition:
A tow truck for the vehicle was called.
Data Master Breathalyzer (ARCT):
Haring was read his ARCT rights and asked to take a Breathalyzer test. At 14:55 he agreed to the test and blew a BAC of 0.11.
Search Warrant:
A search warrant was not obtained for this case.
Interview with Witness (Brooke Munson):
Brook Munson called and stated she witnessed the collision and saw the vehicle operated by Haring drive away. She followed Haring until the stop was made. Munson said she saw Haring driving dangerously in the parking lot and when another vehicle was attempting to pull out Haring collided with the vehicle.

Paul Imbree, the plaintiff , a supervising licensed driver has suffered a serious injury in a road accident in Northern Territory due to the negligence and breach of duty of care by Jesse McNeilly aged 16 years & 5 months old, the first defendant, and an inexperienced driver not possessing any driver/ learner’s permit.
When arrived, he instructed nurses to take possessions of Michael’s clothes and to put them in a locked locker. Trooper Josh Brown became the primary investigating officer of the crash. He went to the accident scene early afternoon the next day after the crash. Showing up to the scene a day later, Brown did not see the vehicle or the state of the vehicle. He was involved in witness interviews, measurements of the crash scene, assisted with serving a search warrant of the vehicle, downloaded the control module of the airbag and prepared an accident report. On February 22nd, 2012, Brown participated in the processing of the vehicle with Joe Pasternak from the Montana Crime Lab. Brown testified Pasternak collected a swab of stain on the driver’s side dash and marked it as Item 15. Brown could not located the evidence to deliver to the Crime Lab. Brown has attended a basic accident investigation training at the Montana Patrol Academy. He relied on Hospital tests rather than the State Crime Lab’s test on Michael’s blood. Hospital results are to be directly for medical purposes and must not be used for legal testing. Brown later admitted he is not familiar with drug screening test and should have consulted with a toxicologist. Brown who has received the accident training did no calculations and never used a computer to assume who was the driver. He also later admitted, that the State never collected any evidence from the guardrail. His opinion was that Michael was driving the vehicle due to the fact he was found near the driver’s door. He interviewed Gloria Wells who describe Michael as being in front of the vehicle and was “scooting”. Gloria then drew a diagram and showed Michael in front of the vehicle. Brown described the forces created inside the vehicle were a forward motion. DNA testing revealed Michael’s DNA was found on the driver’s side airbag. Brown

Amy Miller related she was in the yard at her mother’s residence at 11713 Lithia Pinecrest Road. Miller said she saw a black pickup truck “hauling ass” westbound on Lithia Pinecrest Road. Miller said she maybe 55-60 miles per hour. Miller said shortly after seeing the truck go past, she heard a loud boom. Miller said she ran out to the road and saw a tractor in the westbound lane of Lithia Pinecrest Road and saw a body lying in the roadway as well. Miller said there was also a pickup truck in the grass off the south side of the road, facing east. Miller related she never went to the crash, but did call 911.
GROVE was asked to step out of his vehicle to perform field sobriety tests. ONEILL instructed and demonstrated field tests to GROVE. When performing the tests GROVE did poorly and was unsuccessful at completing them. GROVE was taken in to custody and placed in the back of your AFFIANTS police cruiser.

The vehicle consisted of three passengers. The driver was identified as Ricky Smith, the back passenger was identified as Tony Teauge, and the front passenger was Smith's mother.
Once Matt was at the Juneau Police Department, he was asked to do a breathalyzer test for the Data Master. The officer said he observed Matt for 15 minutes then took a breathalyzer test. Matt didn’t blow consistently, to the test failed. Matt was again observed for another 15 minutes before doing another breathalyzer test and once again, he didn’t do it properly. Matt was observed for another 15 minutes before they tried the test again and his alcohol level showed 150.
On 09-27-2016, I contacted Stepp’s Towing who removed the cars from the crash scene. I was advised both vehicles had been picked up on 09-16-2016. The Mazda had been picked up the registered owner, Viola Christine Cabellero. The Volkswagen had been picked up by Gerber Collision at 9002 E Adamo Drive, Tampa, FL 33619.
