Dual Federalism In The Federal Government

Federalism is the process in which two forms of governments share powers over a certain area of land. The two government powers apparent in the United States compose of state governments and the federal government. Federalism works by splitting up different powers to individual state governments and federal government. For example, state governments have power over schooling and education, but the federal government has no say in this. In contrast, the Federal Government can declare war at anytime they want, but state governments have no say in this. Although these two governments have coexisted for over two hundred centuries, discrepancies have occurred throughout the American history.

Federalism is a division of power in a central government and their regional governments.(Learners.org, Federalism US vs. The States). The first system of federalism is dual federalism. Dual federalism is the state government has their own responsibilities and the national government has their own responsibilities.

In the Unites States of America Federalism is the basic structure of the American government; it is the distribution and balance of powers between the National government and the States government. In order to obtain a compromise between those who wanted stronger state government and those who preferred a stronger national government the founding fathers arranged and settled for a federal system rather than the alternatives of a unitary or confederal system. While both National and State governments each have specific powers and authority, they also share certain powers and must be able to cooperate effectively with each other.

Federalism is the division of power between the national legislature and the state legislatures. It helps maintain power over who wants to control what section each legislature or government wants to take a participation in. Some topics, such as gun control, marijuana and same sex marriage, are large debatable topics that both governments have to discuss whether or not it is helpful for the citizens in a certain state and who should have that particular power. Both the powers are important to maintain any unresolved issues. Since the government is a delegated power, it only has the powers the constitution provides for the government. Lastly we move to federal government this is one in which the powers of government is divided between a central government and several local governments. There is a authority superior to both the central and local governments which makes this division of powers on a geographic basis; That division cannot be changed by either the local or national level acting alone. Both levels of government act directly on the people through their own sets of laws, the officials, and agencies. In the United States, for example the National Government has certain powers and the 50 states have others. This division of powers is set out in the Constitution of the United States.

Federalism is a form of government in which the power to make laws and other specific responsibilities are divided across the national, state, and local governments. How that power is divided has been a constant source of conflict as each level has some degree of autonomy. That is, each level has the capacity to carry out some policies without interference from the others. The national government is responsible for things of national common interest such as, national defense and foreign policy, as well as, responsibilities through implied powers that are inferred in the Constitution. The national government also has the power to declare war, coin money, control interstate commerce, borrow money, manage the postal service, and anything else

The U.S. Constitution was ratified in 1788 and that was the beginning of the political system in America that is still active nowadays. More and more there are debates on how democratic the constitution is, and that is not surprising since Americans still look back at a document that was created 226 years ago. Americans are fighting the constitution regarding all kinds of problems and they are fighting laws that are based on the constitution and the constitutionality of a law. The U.S. Constitution is open for interpretations which makes it a problem in American society because people can interpret it the way it fits them best and makes people become divided on certain issues.

The United States is currently governed under a federalist constitution and has a deep rooted history of setting up its constitution to accommodate transparency, checks and balance and prevent tyranny. The federalist system of government is divided into the co-dependent central and state government. federalism in the united states give states the power to create their own laws, constitutions, and government structures. Federalism in the concept of having a stronger national government over the states. An example of Federalism is the program “ Race to the top” which was initiated during Obama's presidential term. This program's goal was to create competition between states to have higher test scores as initiative for more federal funding. Education concerns are usually left within the state powers.This caused some conflict among citizens who believed that it was in the states jurisdiction. Dual federalism is credited to “in which state and national government had relatively clear responsibilities. The state wielded at least as much authority as the federal government's” (96). Federalism can be said to be the defining feature of all forms of American politics. Even as a literary characteristic feature, America was the first nation to adopt federalism as a concept. Federalism is a system of government whereby political power is divided between a national government and other smaller political constituents such as states. (pg. 4)The relationship between the state and federal governments is very complex. There are certain things that state governments can do that the federal government cannot do, and there are things that the federal government can do that the state governments cannot do. In the midst of it all, the complex situations between the state governments and the federal government can cause many conflicts throughout the country and it can make it difficult for some citizens to keep up with the constantly changing politics.

The term "federalism" describes the changing relationship between the national and state governments as they sort out their roles and responsibilities within the federal system. America has a decentralized government; there is no single source of power or center of government. Federalism goes well with pluralism, because of the multiple centers of power that exist in the government, and also the many divisions of power. There are several levels of government including the federal government, the 50 states, county and city governments and independent school districts. However, the major players are the national and state governments. The tensions between the two are clear when it comes to civil rights, money, and power.
