The legalization of cannabis, much better known as marijuana, is one of the most controversially discussed issues in our country today. Marijuana has many specific medical benefits and is a better alternative to other medications already permitted for medical use. In 2012, two states legalized marijuana for recreational use. An additional 18 states, plus the District of Columbia, had already legalized medical marijuana. Even though marijuana is still illegal at the Federal level, President Barack Obama said very clearly that his administration will not seek to enforce the law in states that have deemed cannabis legal. The specific focus of this article will be on the conflict between the development of policies based on evidence obtained through the use of scientific methods and those grounded on the ideological and political considerations that have repeatedly entered the longstanding debate regarding the legal status of medical marijuana. However, this article will only discuss marijuana for medicinal usage and will not address the continuous question of whether or to legalize or decriminalize the use of marijuana solely for “recreational” use. I want to stress that the core issue is to protect seriously ill patients from arrests and jail, because federal and most state laws subject seriously ill patients to arrest and imprisonment for using marijuana. Unlike licensed businesses that sell liquor or tobacco, marijuana sellers operate virtually anywhere and have no incentive not to sell to children or teens. Prohibition guarantees that marijuana will not be inspected for purity or labeled for potency, and ensures that the only people selling marijuana will be criminals. Our current laws do not control marijuana, but they do ensure that 100% of the profits from marijuana sales remain in the hands of criminals and gangs.
