And if the conduct does not relate to your sex or have sexual references, it's not sexual harassment. 1998 the Supreme Court decided in Ellerth v. Burlington Industries, No. 97-569 and Faragher v. City of Boca Raton, No. 97-282 that companies may be held vicariously liable if supervisors sexually harass workers even if the employees do not report the harassment and suffered no tangible loss. By making employers liable for supervisors' sexual harassment encourages an employer, as no other regime does, to exercise the greatest possible care in screening prospective managers and in training, supervising and monitoring supervisory personnel. It gives employers an incentive to put effective policies and training programs in place. In fact, 54% of Fortune 500 employers admitted in one survey that fears of legal exposure prompted them to establish company policies against harassment. And experience has shown these policies and programs work. In chapter 2 of the Ethics Primer Svara discusses many important ideas. Some of these included the importance of people who work for the government doing their civic duty , 3 types of ethical reasonings brought up by a student, and Lawrence Kholbergs model of moral judgement. In the book Svara brings up how people in certain roles have a job to do. They must meet the expectations expected of them or they aren’t serving the public in a full capacity. As you read on the 3 types of ethical reasonings are discussed. They are virtue, principle, and to be a public employee. This student I feel has a pretty spot on idea of how people should act. Honesty and following the law are just things ethically sound people should be doing. It doesn't take a genious to understand right from wrong. Finally a major point of the chapter discussed Lawrence Kohlberg and his model of moral judgement. “Lawrence kholberg (1981) offers a model of moral judgement to help understand how the capacity for ethical reasoning develops and explains the motives for acting at different stages of development”.(23) More specifically he gives the six stages of maturity children go through. People from all walks of life face many ethical dilemmas. These dilemmas have consequences. Our worldview determines how we deal with these dilemmas, and guides us to the right decisions. In this essay, I will examine an ethical issues through my Christian worldview. I will also present other viewpoints, and compare them to mine.
1. The Mayor of a large city was given a free membership in an exclusive golf club by people who have received several city contracts. He also accepted gifts from organizations that have not done business with the City but might in the future. The gifts ranged from $200 tickets to professional sports events to designer watches and jewelry.
In Rebecca & ‘Zorba’s’ Restaurant case, the main issue is whether negligence exists of the defendant? There are three prerequisites must be present before the tort of negligence can arise: a duty of care must be owed by one person to another; there must be a breach of that duty of care; and damage must have been suffered as a result of the breach of duty. (FoBL, 2005, p70) In addition, another element must be satisfied to prove negligence is the causation. This essay will analysis Rebecca v. ‘Zorba’s’ with these four issues.
The theories of virtue, utilitarianism, and deontology are similar in some aspects but for the most part are very different. Each of the theories will be explained to show their differences and the type of person that would gravitate towards that theory. Through the explanations one would also be able to consider where there morals or ethics may lie but can also see themselves in each theory.
