Police officers may or may not actively support noble-cause corruption. Sometimes when officers become aware of corrupt or illegal forms of misconduct, they are inclined to “turn a blind eye or look the other way.” It puts their fellow officers in a very difficult position, most officers tend to think that if they turn away and ignore it and do not acknowledge what is going on that they are not part of the misconduct or illegal activity. As each new member of a police department officially becomes a sworn member, friends, family and other members of the public gather as they speak an oath. The oath these officers take, promises their commitment to ensure the safety of the public they serve. This means more than protecting civilians from individuals who may stray from the law, but to also ensure the protection of basic human rights. Police and other public servants are given a great deal of trust and power, what they do with it is based on the ethics they choose to uphold. In this paper we will look at why it is important for these justice professionals to study ethics.

Discretion, uncertainly, and inefficiently are rampant and essential in criminal justice. Nobody expects perfection. That would neither be good nor fair. Justice is a sporting event in which playing fair is more important than winning. Law enactment, enforcement, and administration all involve trading off the possibility of perfect outcomes for security against the worst outcomes. Policing is the most visible part of this: employees on the bottom have more discretion than employees on the top.

My first interviewee officers jack Davidson, patrolman from Somers point police department. When interviewing Patrolman Davidson, I found the following to be his impressions of the police force in general. Many officers use alcohol and drugs while on duty. Although this commonly occurs in undercover agents, it can happen with even your regular patrol officers. This type of misconduct occurs because there is typically a lack of supervision, a massive availability of contraband, and an exposure to the criminal element. Graft on the other hand, is when the officer exploits their role by accepting bribes or money protection (Pollock, 2012). Such conduct occurs when officers use their uniformed authority to create a personal supply of money (Lyman 2005). Sexual misconduct occurs when officers use their authority as a way to receive sexual acts from citizens of society. This happens mainly with male officers towards female citizens. This type of misconduct also occurs within the department, mainly through sexual harassment of female officers. The final component of corruption and misconduct is that of criminal cops. These officers have basically switched to criminal activity in their day to day tasks (Pollock, 2012).

In order for a Police agency to prevent and deter Police misconduct, there must be a definition to what actions and behaviors that the term will encompass. The term ‘police corruption’ has been used to describe many activities: bribery; violence and brutality; fabrication and destruction of evidence; racism; favoritism or nepotism. Many different scholars differ in their own examples of the definition. Before attempting to the question of whether a precise definition is possible, it is worth examining the range of activities that might be included within a broad discussion of corruption. Police legitimacy is composed of two elements: trust and acceptance of authority. The public needs to know they can trust the police officers. We have to know if they are honest and are really concerned with our well-being, which would lead to respect and accepting their directives knowing it is for our own well-being or the neighborhood’s. I personally experience both sides of this concept, due to my residential situation, as I live both in El Paso and Juarez. In El Paso I truly trust the police officers that I have encountered, but I cannot say the same about the Juarez police officers. In Juarez many police officers are corrupt and do not care about our well-being. I’m not saying that in El Paso they all do, but their authority is more accepted by its community.

What is police misconduct? It can be defined as any action performed by a law enforcement officer that is unethical by established employment guidelines, unconstitutional, or a crime with in itself. When people hear the term “police misconduct” they automatically think of a police officer using unnecessary force against a civilian. While that is a form of police misconduct it is not only form. Throughout this paper I will bring light to the many types of police misconduct that can happen in the law enforcement industry.

Police officers are trained to read, write and analyze numbers. They are also trained how to handle firearms, identify non-lethal weapons, use defensive tactics effective, conduct search and seizure, driving techniques, investigate criminal acts and the laws of arrest, but how many police take a course on ethical conduct or learn the meaning of sworn oath? Some police officer feel ethics is not important and training is of low – priority. Law enforcement officers take oaths creates an ethical landmine. Officers have to weigh their personal values against colleague demands that may develop a hostile environment and cause ethical issues to flourish. New officers need to know that no profession demands a higher ethical standard than law enforcement. Whether or not there are other careers that require a similar dedication to doing the right thing, it is undeniable that there is a tremendous degree of expectations placed upon police officers. There is a belief that individuals who are considered to be more authoritarian are more likely to apply for a career in policing, and these individuals are more prone to violence (Belur, 2009). Police routinely over-use coercive authority when they are encouraged to maintain a purpose of fighting the war against crime (Skolnick and Fyfe, 1993). The cases that are mostly seen worldwide with police corruption are due to drugs and drug trafficking. Police officers get involved with the “easy money” and believe the theory of “I will not get caught”; it is miserable and emotional to see the United States law enforcement get caught up in these cases. “In 2012, two corrupt cops joined forces with drug dealers and are now facing jail time; they put dozens of criminal cases in jeopardy. Officers Diaz and Patrick Mara admitted to ripping off drug dealers of their methamphetamine during traffic stops. This was the beginning to police corruption in Kern County.”(Richard Winton) The two police officers were corrupt since a while back. “They both pleaded guilty to their charge and got punished for it. Officer Diaz would not fully report the drugs they would find and instead would keep more than half. Officer Mara was caught selling methamphetamine to other individuals.” (Diaz and Mara admitted) Other cases they were involved in are now put under jeopardy and could possibly be missed charged. Cops should not allow such horrific thing to occur. If they know about a corrupt cop they should immediately report it. People and younger
