A Federal District Court judge in Manhattan ruled in June of 2013, that Fox Searchlight Pictures had violated federal and New York minimum wage laws by not paying production interns, it was a case that could radically affect the long-held practice of businesses to rely heavily on unpaid internships. The judge had decided that Fox Searchlight should have paid two interns on the movie “Black Swan,” because they were essentially regular employees. The interns were made to do basic chores usually done by paid employees. The interns were made to take lunch orders, answer phones, track purchase orders, and take out the trash. The judge noted that these internships did not provide an educational value and that the studio received the benefits of the work (Greenhouse). The “Black Swan” case epitomizes the recent trend in case of unpaid interns. Interns are used as “free labor” and being treated unfairly. The “Black Swan” case was the first in a series of lawsuits filed by unpaid interns. Internship is a period of work experience offered by an employer to give people (usually college students and graduates) exposure to the working environment. Internship is a six to eight weeks working experience in any organization. The purpose behind doing an internship is to get familiar with a professional working environment. Often students do internships during there vacations so as to gain experience in their field of interest. Students studying engineering, computer science, textiles or business management; they are required to perform at least an internship so as to receive degree from their respective institutions. In “Federal Minimum Wage”, New Zealand and Australia enacted the first minimum wage law during the late 19th century to prevent employers’ exploitation of workers. In 1912, Massachusetts passed the first minimum wage legislation in the US that was enforced for women and children, and fifteen more states followed in the next eleven years. However, the Supreme Court abolished the minimum wage laws in 1923 because the laws violated the women and employers’ Fifth Amendment or their right to negotiate a binding agreement without government interference. In the US, the first federal minimum wage law passed 25 cents per hour as part of President Franklin D. Roosevelt’s Fair Labor Standards Act (FLSA) to help struggling workers during the Great Depression (“Federal Minimum Wage”). Since 1938, the minimum wage law has increased twenty-two times to $7.25 to keep pace with inflation. However, minimum wage laws have exemptions in some field of works such as tipped employee who earns $2.13 an hour in direct wages if the amount plus the tips received is at least the mandated minimum wage. In addition, agricultural workers earn their salaries by the number of bags or weight multiplied by the crops’ selling price (“Minimum Wage and Overtime Basics”).
The federal minimum wage law was signed in 1938 by President Franklin Roosevelt in order to keep people out of poverty and increase consumer purchasing power. This has done the opposite by hurting businesses and reducing employment, while minimum wages go up, so will the costs of living. Most of the people working for minimum wage are 16 between 24 years old, 37% of workers are going to school working part time. Enrollment tuition has increased over the years, and raising the minimum wage could mean further increasing expenses. But, for people who aren 't pursuing an education and begin working right out of school, the federal minimum wage $7.25 looks like it can be hard to live on. Raising the minimum wage would most likely increase with the cost of living, making cost of living or tuition even more expensive, making it harder to pay for groceries or bills. Just because someone starts out at a minimum wage job, doesn 't mean they can 't progress through the company and earn a better wage over the years. Minimum wages are more for entry level paying jobs that don 't require any certain set of skills to be able to do what they ask. Maintaining the current federal minimum wage of $7.25 will help stop rise of inflation.

Currently, I am a sophomore studying Molecular Microbiology and Immunology at the University of Nevada, Reno. As a college student, one of the most important aspect of my education career is to gain different kind of experiences from opportunities that are offer at the university. Personally, I believe that completing a paid, local internship can give students, such as myself, the chance to gain valuable work experience and build networks and connections, while applying knowledge and skills in real life settings. Every type of experiences that exist, such as internships, offer me the chance to enhance my strengths, understand the world around me, and to push myself in continuing to develop as an individual to become successful in life. For example, I was selected as an art intern for the Summer Business Institute Program in Summer 2014. Throughout the eight weeks of exploring to arts, I had an opportunity to work with a team of artists to create a mural and an art piece for two local community centers in Las Vegas as well as organizing a civil engagement project for a neighborhood that have families who are in need of financial aid. Daniel Miller writes, “Unpaid interns who had worked at Fox Searchlight Pictures filed a lawsuit five years ago alleging the company violated the Fair Labor Standards Act by not paying them for their work.” (July 12, 2016) This lawsuit could be instrumental on how Hollywood handles Interns. The companies need to take note and ensure their intern follows the guidelines of what an intern is. Our textbook lists six defining factors of a trainee for the FLSA on page 27 which should be circulated through all businesses. Furthermore, the former interns were rewarded the amount of $7,500 to $495 depending on the time they worked for the company. I believed company would have saved themselves the headache of a lawsuit by simply reading the guidelines for interns prior to hiring them. In this particular experience at Accounting Firm X I did in fact gain substantial professional skill while participating in new and challenging experiences. Internships allow in- class material to come to life in a practical manner. My internship did do this but not in a way that I had planned.
