Police officers have the California Penal code 835a under their disposal. 835a lets officers use reasonable force to effect the arrest, prevent escape and overcome resistance. Police officers are never fully informed of each call they receive. Many officers are trained to quickly respond and modify their approach whenever a call gets picked up. Officers are trained to assess the situation and adapt. Citizens at home on the other hand, are being informed of the details after facts are released. Officers are trained to protect themselves as well as the greater public. Whenever a police officer exercises use “force”, officers are mandated to file paperwork and provide statements of what occurs. Law enforcement officers are given much power and authority over one’s civil liberties. Not only do they have a duty but also a responsibility to enforce laws and ordinances in their jurisdiction, maintain order and protect its people. In some cases, the only way to accomplish this is through legitimized use of force. Use of force can best be described as "the amount of effort required by a law enforcement officer to induce compliance of an unwilling subject" (nij.gov, 2012). With that said, law enforcement officers have been given the right to apply only enough force necessary to control a situation, while defending others, preventing escape, during self-defense and while a subject is resisting arrest (Pollock, pp. 234). It is not until that force becomes excessive that it becomes say an issue.
Police officers are given a lot of power because it is needed to help protect citizens and the community. However, police often abuse their power by the over use of force, corruption, sexual misconduct, bias based policing, and failure to maintain police ethics. (Peak, 2011)

Others say that these actions are due to racism or post 9/11 paranoia. Whatever the excuse may be for these cases, there should be no need for violence anywhere. Police brutality videos go viral and reveal to the world that it actually happens and that it may happen to you too. What is police misconduct? It can be defined as any action performed by a law enforcement officer that is unethical by established employment guidelines, unconstitutional, or a crime with in itself. When people hear the term “police misconduct” they automatically think of a police officer using unnecessary force against a civilian. While that is a form of police misconduct it is not only form. Throughout this paper I will bring light to the many types of police misconduct that can happen in the law enforcement industry.
When thinking in The Police, as responsible for law and order, people often expect respect to the standards and protection. But, when law enforcement goes beyond the boundaries of civil rights and becomes abusive, the relationship between those involved just breaks out.
In recent months, there have been a number of different riots and demonstrations occurring to show just how displeased our nation is with the current treatment of American citizens by the police. These movements have been created out of the turmoil that ensued after several different civilians were shot down in the streets by police officers after an encounter. It has become easy for people to look at these incidents and consider them isolated, and downplay the problem at hand. However, statistics taken from the United States Department of Justice would show otherwise. During a national survey, police departments were questioned about abuse of authority, and showed us that most departments have an internal discipline problem, where rule infractions, unmoral behavior, and emotional and physical abuse are overlooked. Forty three percent of cops interviewed said that “Always following the rules is not compatible with getting the job done” (Cop Crisis, 2015). When the rules are put to the side, and the reasoning behind the laws and opinions that put those rules into place is lost, then anything can happen. Over half the cops interviewed, fifty two percent said “It is not unusual for a police officer to turn a blind eye to improper
Law enforcement officers are constantly bombarded with different types of situations that they need to make split second decisions on. Their decisions in any given situation can fall under scrutiny from the citizens, the news media, and even the courts. This makes the jobs of all law enforcement personnel extremely complex. Policing is a difficult and challenging occupation. A law enforcement officers’ duties are plenty, but the main focus is protecting people and property. To do this, they patrol specific areas assigned, respond to calls for service, enforce laws according to their state, make arrests, issue citations, conduct traffic stops, and appear in court to testify. Law enforcement officers do this knowing full well that their actions,
There was no set beginning to when police brutality began. Ever since the Civil Rights movement, police brutality, specifically against young black men, has been a rising issue in the United States. Unfortunately, police officers are usually acquitted from their charges, even in the worst cases. The reasoning behind this is police officers are commonly seen as trustworthy and accountable. Another root behind this issue is citizens are more likely to perceive black people as ‘criminals’ or ‘dangerous.’ This gives an advantage to the police officer and leads them to being dropped from all charges. However, how do we defeat the issue of police misconduct? What approaches must be taken to reduce the number of unarmed citizens being shot and killed?
Imagine, you and your friends are driving around listening to music and having a good time, you guys have no drugs or alcohol. A cop pulls you over no reason, probably the loud music, maybe you were speeding, who knows. The cops come up to your vehicle, one of them start talking then he “smells” something. The officers make everyone get out as they search the car.You think to yourself, we didn 't have any drugs, they won 't find anything, wrong. The cops somehow find a little pouch of cocaine. Now you and your friends face up to 3 years in jail and $20,000 in fines. This is an example of what we would call Police Corruption.
