Regulation The way a society functions is strictly based on the type of culture in which they reside in. A individuals, habits, actions and personality are all shaped, by the infrastructure, rules, and regulations that they have to abide by while residing in society. It is not to say that these policies are a negative notion, but they do certainly shape your lifestyle, and your choices in many ways. By taking a look at regulation it is important to note that, our government has a huge role in the lives of its citizens it resides over. The United States Federal government has its exercise of sovereignty, in other-words, it has legal and accepted authority to regulate people’s living within a certain geographic area that it has jurisdiction …show more content…
Regulation is a major activity at all levels of government. As society becomes more complex, regulations must grow and evolved to meet the demands of a developing society. Concentrating more on the role of regulation, it can be noted that it is a system that helps protect individuals from one another. So from buyers to sellers; from employee to employer; tenants to landlords, and so on. Regulations is also implemented to alleviate human suffering and promote overall welfare. For instance, aid in the form of Social Security and to Veterans, natural disaster relief, regulation of pollution and toxins, as well as temporary assistance for the unemployed. Last, and most importantly regulation is implemented to minimize and eliminate corruption and abuse of power by government agencies or officials. (Book Source) Taking into account the terms and ideologies stated above, it is easily understood why, we as individuals have decided for so many years, to abide by this social contract with our government. We gain the most benefit from this quid pro quo relationship. Administrative Law and Regulatory Agencies Since we abide by this social contract, it is important to understand how this system works for its citizens that it has jurisdiction over. By looking from the outside in, how our government operates is illustrated by its
“For example, the federal government regulates the quality of food and water, the safety of workplaces and airspaces, and the integrity of the banking and finance system.” (Bianco, Canon 2011, p 582) Regulations find out if the product is a market failure. There are two types of regulations, which are economic and social. “Economic regulations sets prices or conditions on entry of firms into an industry, where as social regulation address issues of quality and safety.” (Bianco, Canon 2011, p 582) Economic regulations are concerned with the price regulation of monopolies.
In an ordered government the rules and regulations are meant to help protect and provide for the people. These rules
When the framers of the Constitution developed our government, they gave Congress the authority to create the departments necessary to carry out the day-to-day responsibilities of governing - the federal bureaucracy. The vast majority of the departments, agencies, and commissions that make up the federal bureaucracy today were created by Congress through legislative acts. Congress is unable to act in a bubble though, due to the nature of the system’s built-in checks and balances, Congress must first get the president’s “buy off” which is represented by his signature. Although Congress has the authority to create these agencies (with the president’s agreement
The purpose of this paper is to assess different types of government regulations, how those
In America, the debate over the warranted degree of government involvement in one’s daily life is ever-present. As citizens, Americans demand protection and security from our leaders. In return, they provide capital, ingenuity, and a responsibility to society. As can especially be seen in the current time of recession and bailouts, citizens rely on the government to regulate and stabilize of our economy - to act on behalf of their wellbeing. However, this has not always been the case. Subsequent to western expansion, the government was hesitant to impose regulations upon its citizens, especially in relation to their economic pursuits. Political leaders relied on powerful businessmen’s’ support for occupational security - so formed the
The federal government shouldn’t telling us how to live our lives. The government is prohibiting us to text and drive, talk and drive, smoke around children. We as citizens need to learn to resolve these matters with guidelines not demands. We will never grow as a society if the government continues to put restrictions on our every movement. If one person makes an error and all of sudden there is law to make sure their error never happens again, we will have so many laws we will become puppets to the government. The way the laws are influencing our lives may cause this domino effect.
The Insurance industry is very heavily state regulated. According to the Government Accountability Office (GAO) study, the state run regulatory system is Federal verses State Regulation protecting the markets, insurance industry and policy holders and was evidenced during the financial crisis of 2008-09. The insurance business is highly profitable. “Well-run companies can make a lot of money, which breeds competition” from both “inside and outside competitors” (Property, 2013). Insurance companies were well “insulated” from the “severe” financial crisis of 2007-2008 that affected the banks and security firms, because the State regulations have the Insurance Industry “walled off” from Federal Regulations (Property, 2013). During the “Great Depression of the 1930s” “Insurance policy holders were protected by the states’ prudent supervision and regulation” (Property, 2013).
As a child grow up, he or she is usually lectured by their parent about rules. Rules about curfew, television hours, computer hours, study hours, chores, and more. These rules are set to help the child be more like the parent. If a parent does not like the act of burping and believes it is improper, he or she may stop a child burping for the purpose of making the child act like them, the parent might say no burping inside the house in a very strict manner. Similar to a government, a government will make rules to help make society be more like the government. For example, the constitution is full of laws to which we as a society are supposed to follow. These rules were made by the government and therefore are in favor of the government’s expected behavior. If our society follows them, then aren’t we acting in favor of their behavior, which is how they behave?
Regulations control people through their life’s, but sometimes people get away with it. Without regulations I think people wouldn’t even exist. Now, breaking some regulations is okay, but it really depends on which ones you don't follow.
As indicated by “THE CONCEPT OF SOVEREIGN OR GOVERNMENTAL IMMUNITY”, a state may not be sued in tort without its assent. In spite of the fact that the regulation is subjected to rehash legal difficulties, is held fast to in countless. It is the dispute of this article that the explanation behind the guideline no more exists and that it ought to, subsequently, be nullified as a controlling legitimate standard. Be that as it may, it is presented that sovereign resistance abuses the due procedure and equivalent security provisions of the United States Constitution.
Governmental power contradicts with how our society functions as a whole. In today’s society the government influences the lives of many with how we need to treat others. For example, in 2016 after the presidential elections, a young African American girl by the name of Nida was bullied and terrorized for the color of her skin. A young boy had told her that her family was going to get kicked back to their country now with a new president sending illegal immigrants back to their home country (Kowalski).
It is ironic that one seems to forget the function of a ‘state’. A ‘state’ will not be a ‘state’ without its citizens in it. Together, the citizens in a state collects and raises fund (in the form of paying taxes) so that the funds can go back to the citizens in the form of welfare services such as infrastructure, transportation, health care and education that benefits the whole society. Welfare state should also act like a social insurance that protects its citizens from losses, which came from unforeseen circumstances. For that reason, a state has the right to implement rules and regulations to minimize the risk of these losses. Examples of these rules include using seat belts and child restraints, raising tobacco prices, limiting access to pornography sites, and other regulations that would be more effective if the citizens undergo a change in lifestyle and behavior. Therefore, cooperation between all members of a state is needed to ensure that the welfare system works
I think that without the regulations a government provides everyone would be doing what they want causing the country to turn into chaos and eventually there would not be any people left living. My view on government and the protection, resources, and regulations it provides has a lot to do with my political typology.
Every economy needs regulations to a certain extent, but how much is too much, and how exactly do regulations even affect the economy of the country? Those are key questions that many are asking, and don’t truly have answers for.
In the past century, government has expanded and become more involved in many new fields and aspects of life. One reason for this change is that government has more to because the population has increased by 600 percent over the past 100 years. More rules and regulations are needed to keep larger numbers of people living and working together peacefully. Another reason for government expansion is the growth of cities. The government has been forced to accept responsibility for the water supply, transportation, fire and police protection, and waste disposal in urban areas.
