The Magician, the Witch, and the Law was a timeline of the people, events, and documents that significantly influenced the development of magic and witchcraft persecution. Edward Peters formed his timeline beginning with early Christianity and ending with the sixteenth century. The study argued that these people, events, and documents led to the persecution and burning of witches in the seventeenth century. The timeline began with the explanation of harsh Greek and Roman laws against magos. The laws were harsh because magic was a disruption of society and the cause of political instability (9). The purpose of many of these writings was not to describe actual events. Anselm of Besate was one author who wrote this type of literature. Anselm authored an influential piece of literature called the Rhetorimachia. Anselm wrote about magic, witches, and sorcery in a fictitious manner; he was a writer. Like an artist, Anselm’s writing was a medium to show his skill and creativity; the literature was rhetorical. Anselm wrote Rhetorimachia for an audience to enjoy. Peters lays out three theories about why Philip IV persecuted the Templars. First, for their money. Second, Philip wanted to be King of Jerusalem and give France to his son. Third, Boniface VIII humiliated Philip when he accused Philip of crimes against God. Philip did not believe that the Church who accused him was the real Church. The false Church had false followers who practiced idolatry, the false followers including the Templars. Philip wanted to eradicate this fake Church. The Templar’s trial was significant because magic and sorcery was viewed as idolatry; sorcery and magic was an attack on Christianity. The idea of a vulnerable Church continued into later centuries, which ultimately strengthened the Church by offsetting the vulnerability. It is important to understand the meaning of witchcraft to be able to identify what caused the massive witch-hunt in Europe. During the medieval to the early modern period witchcraft was identified as the practice of harmful, black or maleficent magic caused by a witch (Levack, 1987, p. 4). They also describe them as evildoers that associate with the Devil, kidnap children, and murder others. These accusations were untrue rumors made by the Catholic Church to promote Christianity and punish those who did not follow the church beliefs. (Levack, 1987, p. 7)
In the mid-seventeenth century there was a great increase in the number of witchcraft accusations, more precisely in a little country located in southern Europe called Malta. At this time in Europe there was a system of tribunals, a court of justice, created by the Catholic Church called the Roman Inquisition (Carmel. 1993: 316-317). Before the 1500s, prosecution of witches was rare. Trials were conducted against those who were seen as suspects of “practicing harmful magic and occasional mass trials" (Bever, 2009, p. 263). These accusations were often made by children and that of their imagination. The decline; however, occurred not through the prosecutions but through its “suppressing roles” and the overall “decline in witch beliefs” (Bever, 2009, p. 285). Witchcraft was defined for the masses by the publication of the Malleus Maleficarium also known simply as the Handbook. Written by two Dominican friars in 1486 it’s purpose was to be used as a handbook to identify, capture, torture, and execute suspected witches. Opinions stated as facts and written in the Malleus Maleficarium, “handbook”, were based their faith, church doctrine, and the Bible. No doubt a religious masterpiece in it’s time this handbook is a neatly woven together a group of beliefs, experiences, wisdom of ancient writers, religious ideas, and God inspired writings that justify it’s purpose. Written by and used by Catholics this handbook proved useful for Protestants as well. Based on biblical interpretation and ideas the handbook provided Protestant Church leaders biblical authority to prosecute witchcraft as well. Translated into today’s vernacular phrases such as, “everybody knows that women are feeble minded” or “everybody knows that women are more superstitious than men” and “all women have slippery tongues” are included in the handbook and presented to the reader as foregone conclusions. From the 1400’s to the 1800’s, around forty thousand individuals were executed for witchcraft, most of which occurred throughout central Europe. Constant religious and political upheaval caused elites to attempt to harness control over populations, which led to multiple laws being passed in regards to witchcraft. Torture was allowed and women and children were called to testify in the court room. Individuals who were seen to be outcasts on the outer edge of society were immediately targeted and easily suspected of sorcery. The Trial of Tempel Anneke: Records of Witchcraft Trial in Brunswick, Germany, 1663 gives its readers an inside perspective of the many different attitudes that existed towards witchcraft at the time. Because 17th century Brunswick townspeople were driven by deep Christian beliefs, they greatly feared all forms of magic, thinking them to come from the devil. Yet despite these fears, they did not completely reject witchcraft as they often sought out purported “witches” for magical solutions.

These men and women were believed to have practiced magic and act as healers for the members of society (McLean). When Christianity collided with folk culture, many townspeople viewed the Christian clergy as similar to the cunning folk (“The European Witch Hunts”). Eventually, the clergymen claimed that their powers came directly from God, and any other magic was the work of the Devil (McLean). They called the people who practiced this magic, the people formerly known as “cunning folk,” witches (“The European Witch Hunts”). Witches and witchcraft were observed with fear and condemnation but very little violence. Around 1000 CE, as the “concept of Satan, the Biblical Devil, began to develop into a more threatening form,” the idea of witchcraft began to be seen as a dangerous and terrifying to Christianity and God (McLean). While there were witch hunts between the 11th and 14th centuries, the prevalence of the Black Plague caused a staggering increase in the amount of accusations (Lewis). In the 1680’s and 1690’s there was mass hysteria in New England over supposed witchcraft. The most famous outbreak was in Salem, Massachusetts, hence the name Salem Witch Trials. In Salem, there were young girls who started acting strangely, and they leveled accusations of witchcraft against some of the West Indian servants who were immersed in voodoo tradition. Most of the accusations were against women, and soon the accusations started to shift to the substantial and prominent women. Neighbors accused other neighbors, husbands accused their wives, etc. and it kept going on for a while. The evidence of witchcraft and related works has been around for many centuries. Gradually, though, a mixture a religious, economical, and political reasons instigated different periods of fear and uncertainty among society. Witchcraft was thought of as a connection to the devil that made the victim do evil and strange deeds. (Sutter par. 1) In the sixteenth, seventeenth, and twentieth century, the hysteria over certain causes resulted in prosecution in the Salem Witch Trials, European Witchcraft Craze, and the McCarthy hearings. These three events all used uncertain and unjustly accusations to attack the accused.
When analyzing all of the information provided in the two books, Witchcraft in Europe by Alan Charles Kors and Edward Peters and Magic and Superstition in Europe by Michael D. Bailey, there are a multitude of common themes that appear repeatedly in both pieces of work on the topic of witchcraft. These common themes vary in topic with some relating to the stereotypical appearance of witches, the actions witches performed, or even the legal procedures involving the conviction of witches. These themes do not only show themselves in those two pieces of work, but also in The Trial of Tempel Anneke by Peter A. Morton.
