The Impact Of Crime Policy On Crime And The Administration Of Justice

Our society for the most part has a set of written laws by which it operates under. Laws govern our behavior in society and list punishments by which individuals that break them will be prosecuted and sentenced. Our criminal justice system is essential made up of three major intuitions which see a case from the beginning and through the trial and finally to the punishment phase ("How Does the Criminal Justice System Work?," 2014). Our society needs laws and punishment for those who violet the laws otherwise we would live in a world of chaos. In this paper we will examine various aspects of the criminal process from arrest through sentencing and appeal.

Prisons where essentially build to accommodate a number of prisoners but over the years it has reach over capacity. Today in the United States there are approximately 193,468 federal inmates that consisting of the Bureau of Prisons Custody, private managed facilities and other facilities. The inmates ages range from 18- 65 with the median age being in their late 30’s. This number is counting both male and female population with male being 93.3% of inmates and females being 6.7%. The number of inmates has steadily increase since 1980 with only having approximately less than 50,000 but today the number has gone more up. Drug offenses are the highest number for inmate’s imprisonment, the next highest offense would be weapons, explosives and arson; immigration and miscellaneous fall next in lines. The number for the other offenses such as robbery, extortion, fraud, bribery, burglary, larceny, property offenses and other offenses are lower. Overcrowding prison has become problematic as the prison population continue to increase leading to proper care and attention for prisoners.

Criminologists have long tried to fight crime and they have developed many theories along the way as tools to help them understand criminals. In the process of doing so, criminologist have realized that in order to really understand why criminals are criminals, they had to first understand the interrelationship between the law and society. A clear and thorough understanding of how they relatively connect with criminal behavior is necessary. Therefore, they then created three analytical perspectives which would help them tie the dots between social order and law, the consensus, the pluralist and the conflict perspectives. Each provides a significantly different view of society as relative to the law. However, while they all aim to the same

Three models portraying our criminal justice system are the Wedding Cake Model, Criminalization Model, and the President’s Commission Model. The Wedding Cake Model “emphasizes that the system handles different kinds of cases differently; it depicts four layers or tiers of cases”. While the Wedding Model offers an accurate typology of cases processed through the system, its primary focus is on the decisions of prosecutors, defense attorneys, and judges. There is a glimpse the role of power and status in such decisions, but the factors of race, class, and gender are not explicit. But, this model does not address the lawmaking process and the social inequalities in the economic and political systems in which laws are forged. Now the second model, the Criminalization model explores the role of social class in the criminal justice system. It shows that the system is used to control certain groups of people by criminalizing their behaviors and targeting them for arrest and incarceration. The third model, the President’s Commission Model provides the most famous portrayal of the criminal justice system by summarizing the stages of the system. In comparison, the Wedding Cake Model and the Criminalization Model are similar because they both show the recognition of power and status in the criminal justice system. The Justice system seeks to prevent crimes and to capture those who have committed crimes. But what are the causes of crime, maybe poverty, or greed, or is sometimes caused by the system. Is the risk worth the reward and is reward the worth risking the punishment? Power and influence is threaded deeply into the Criminal Justice System. Are all offenders caught and processed with the same demeanor and given the same punishment? The system needs to be impartial to all offenders regardless of the offender’s social position, job or yearly income. Reiman and Leighton comprehensively begin the discussion of crime by outlining their main objectives, establishing the immediate problems surrounding crime control in America, and setting the groundwork for their premises. In recent years, the crime rate in the United States has declined. This decline is generally attributed to ‘tough on crime’ and mass incarceration policies, but the authors are quick to assert that other variables--economic, social-- are greater contributors to this decrease, with the ‘imprisonment binge’ only actually contributing a small amount to the decline. These strict crime enforcement policies might have a small impact on crime prevention, but criminologists are concerned with the potential effect such policies might have on criminal justice procedures--promoting profit rather than safety-- and endangering citizens’ rights (particularly those considered minorities).

In society, things are not as they seem at times. The criminal justice system was created to help deter crime and to punish those who break the law. Laws are put in place to be fair to all citizens. Your economic situation, gender, race should not become a factor for you to be given “due process”. Years have come and gone and the crime rates increases and decreases with the years. There have been many senseless killings and everyone has their point of view as to the causes. The focal point of this report will be the findings from the readings of, “The rich get richer and the poor get prison by Jeffery Reimer and Paul Livingston”. I will discuss the causes of the rise and fall of the many different types of crimes ; why the rise and fall of crime rates; what contribution has the criminal justice and or police system has contributed whether positive or negative; and lastly discuss which economic group ends up in prison and why.

Within the past decades, there has been a noticeable increase in the number of heinous crimes committed, causing some of the laws to significantly change. During the 1970s, some dramatic changes occurred when laws shifted from one extreme to another: rehabilitation to retribution. Such circumstances created an additional emphasis on the offense rather than on the offender. During the 1980s, the “get-tough-on-crime” era began; thus, radical changes in laws continued up until the late 1990s. Throughout the period of the Industrial Society, the United States had two bipolar types of punishment: harsh and lenient. Today, the main focus of the Criminal Justice System is about retribution and punishment.

Criminal law is a construct of the government, enforced through tangible measures. In a democratic society, the government is elected by the citizens, and as such, laws are generally conceived with the aim to reflect whatever ethical or moral standards are presently acceptable. However, in order to be truly effective, some legislation must circumvent current sociological viewpoints in order to create laws that are genuinely in the best interests of society. This results in a delicate balancing act, as lawmakers attempt to weigh the views of the majority against the need for laws to be both reasoned and objective.

The crime rate is the result of problems in public safety. As one of the most important public good, safety has generates positive externalities that helps urban development. However, due to the fact tighter police protection budgets yield the local law enforcement to maintain or improve the efficiency of policing with fewer hands and resources. Will an increase in justice expenses bring us a safer local environment? Can the crime problem be improved by increase justice expenses?
