It is time that people take a stand against public and campus hate speech, minorities feel attacked and harassed by it. The only way to fix the problem is by shedding light to the issue. As a minority in America I know how it feels being discriminated against. Seeing hate speeches through the television and hearing about it recurring hurts me as a minority in America. I could not imagine going to college and having to listen to negative and demeaning verses being spewed. Most people being publicly discriminated against would feel very uncomfortable. No student should have to deal with hate speech going on in the campus they attend. Students feel targeted when hate speech is directed to them on campus, which should not happen, especially in an educational institution where students go to learn
Although people say that the first amendment protects hate speech on campus, they are wrong. According to New York Times, over 300 colleges and universities have adopted hate speech codes in America. The hate speech codes consists of hate speech becoming unprotected speech on their campus and could be subject to consequences. The consequences now a days for public hate speech could lead to being arrested, suspension from school, expelled from school, or even fined.

With a wide variety of people on colleges campuses, it is almost impossible to please everybody; whether it comes to class times, bus schedules, or grading rules, somebody is upset. As well as these smaller issues, more controversial arguments come into play. One of these arguments is against free speech zones on college campuses. These zones restrict speech to a specific area on campus, however, still allowing any type of group to express their beliefs to anybody passing. Some claim these zones as unconstitutional because it restricts a student’s right to free speech. However, others view the zones as helpful in controlling protests and current tensions on campus. Open speech across campus is incredibly difficult to monitor because of the enormous size of current day campuses and the immense amount of different views. In the past, there have been situations relating to violent protesting and negative speech across campuses. Because of this, campuses have begun enforcing free speech zones in which students and faculty may verbally express their beliefs.
Even though hate speech can be damaging to the targeted victims, it still cannot be set to a standard or principle because it is hard to define what is and is not hate speech. Hate speech is so wide-ranging and vast, no limit can be set to regulate it. What some groups may consider to be hateful and demeaning, others groups deem to be their founding principles and beliefs. A study taken place at University of Colorado quotes, "Often, when hate speech prohibitions are in place, people engaged in serious intergroup conflicts simply refuse to talk at all, preventing constructive problem solving and allowing tensions to build." American Civil Liberties Union suggests the best way to counterattack hate speech is to not censor it, but to respond with more moral speech. ACLU goes by the principles that the rights of free speech are indivisible:
Although the First Amendment states that we should award the greatest amount of speech, racial speech is not deserving of this award because these words are meant to do nothing but harm another individual. The only time that speech may be regulated is when the victim is unable to get away from the racism such as in the home or in college bathrooms and common rooms. According to Charles R. Lawrence III, hate speech in the United States is unacceptable and represent it’s kind of restriction on the use of free speech. On his speech on hate speech, he claims that the hate speech silences the voices of the minority groups among the citizens and causes them to be excluded from free exchange of ideas and the promotion of their right to freedom of expression. In his speech, he first examines the Supreme Court outcome and decision in Brown vs. Board of Education case, where he urges that this is one of the most important facts on the equal protection laws in the United States of America. In this case, he shows that prejudice is part of racist speech. Furthermore, he extends that everyone is entitled to participation as a member of society and that separate schools undermine the idea of expression. Additionally, he asserts that hate speech restricts the involvement of these minority groups and thus it should be legislated.
“Over the years, courts have ruled that college officials may set up reasonable rules to regulate the ‘time, place and manner” that the free speech can occur, as long as the rules are “content neutral,’ meaning they apply equally to all sides of issues” (Fisher, 2008). Speech codes and free speech zones on campus do exist for many reasons: many of the causes or topics that students or others looking to interact with students take up are controversial and can frequently take on less of an academic or social justice overtone and more of a hateful one. Hate speech is the greatest threat to freedom of speech on college campuses, and the limitations colleges and universities put on student’s verbal freedoms are largely in place as efforts to avoid it. Religion, in particular, is a hot topic on campuses and it has an unfortunate tendency to become more aggressive and argumentative than universities would like. However, under the First Amendment, individuals do have a right to speech that the listener disagrees with and to speech that is offensive and hateful. It’s always easier to defend someone’s right to say something with which you agree. But in a free society, you also have a duty to defend speech to which you may strongly object.
Universities that have been trying to quash free speech have encountered some court reversals of their attempts. But campus leftists have not given up. The newest university gambit to limit speech mirrors the Equal Employment Opportunity Commission guidelines concerning sexual harassment in the workplace, (creating a hostile environment) or they attempt to base their speech code on the "fighting words" doctrine enunciated by the Court in Chaplinsky v. New Hampshire
Envision ambulating down the street and then out of the blue someone shouts obscenities predicated on the way people look or because of what they affiliate with. Incidents involving animosity happen everyday, and most are looked at as daily occurrences. With the current state of hate speech laws, there is nothing that could be done to put culpability on the instigator. Hate has a strong connection to United States history. Slaves were a result of being hateful to those who were different, and Jim Crow laws were also a consequence of this hatred. As much time has passed since then, America has become more progressive, although there are still people who are hateful of others for they way they are. Hate speech laws are necessary in the United States and should be passed because passing them would create and foster a more tolerant society, help to decrease the negative risk associated with them, and prevent violent acts of hate which tend to be preceded by hate speech.
All around the country, colleges and universities are increasingly punishing or censoring students who engage in offensive speech. Concerns indicate that a failure to act will lead to liability under federal anti-discrimination law. In many instances, the possibility of liability is weak or non-existent. “Except in the most extreme circumstances, schools are not required to expel students for their speech in order to avoid liability.” Instead, schools are punishing students for their demonstrations of free speech if it opposes the “safe space” and inclusive environment that colleges and Universities have been trying to promote. Just a couple of months ago white supremacists rallied in Charlottesville to protest the tearing down of the statue of Robert E Lee. The racism and hate they spread through their march is unquestionably disgusting and serves no purpose in our society today. This event has led to social media sites such as Twitter to crack down even harder in a plight they started over a year ago to silence hateful speech. While there are some occasional dissenters, the general population agrees with the opinion that this speech is awful in every sense. With that being said, censoring their right to free speech is a bit too rash. We can all agree that free speech is one of the most important rights we have, and with President Trump throwing around the term “fake news” at major news organizations, it is more important than ever to protect that freedom. The article “The case for restricting hate speech” by Laura Beth Nielsen of the Los Angeles Times gives an argument for why hate speech should be censored. While she provides valid points, with the absence of factual statistics, none of them are strong enough to support her thesis that hate speech should be banned. I believe that in almost every instance, hate speech should remain protected just as much as our right to free speech.
Nearly all colleges and universities have adopted some form of anti-discrimination/harassment policies. These policies are meant to ensure that no student will be discriminated against due to race, color, national origin, religion, sex, sexual orientation, age or disability. Many universities have adopted more specific policies regarding “hate speech” which prohibits speech or conduct that creates an intimidating, hostile, or an offensive educational environment towards minorities, women, gays and lesbians, and the disabled. The problem with universities enforcing a strict speech code is that it is often a vague policy that in itself is discriminatory as it violates The First Amendment. The case of Omar Mahmood, a student at the University of Michigan who was disciplined for writing a satirical article, “Do the Left Thing” illustrates the problems with these types of policies.
Recently, there has been a lot of discussion regarding free speech on college campuses. Our first amendment gives us the right of Free Speech but many groups retain the ability to censor it within their own organisation, such as in the workplace and in both public and private lower education. I believe that the ability should be extended to colleges and universities (both public and private). Students should have the right to be at school while feeling physically safe. An example of this right being violated because of someone else’s “free speech” was last spring at American University in which bananas were strung up on nooses around campus with AKA (a historically-black sorority) labeled on them the day after AU’s first black female student

Speech that attacks a person or group of people on the basis of race, gender, or sexual orientation is regarded as hateful. It has the potential to incite violence or prejudicial action against or by a protected group of people. In Millian Principles, Freedom of Expression, and Hate Speech, Mill makes the claim that essentially all speech, including hate speech, should be allowed. This claim holds its validity as long as no harm is done to an individual. Here, I will show that low value speech fails to engage deliberative views that underlie central first amendment fundamental liberties. Subsequently, I will support these claims by comparing the aspects of hate speech to low value speech. Lastly, I advocate for the prohibition against the use of hate speech in a university setting.
Hate speech, what is it? The definition of hate speech, according to Mari J. Matsuda, author of "Assaultive Speech and Academic Freedom, is " (a word of group of words) of which is to wound and degrade by asserting the inherent inferiority of a group" (151). In my own words hate speech is a humiliation and demeaning slur of words specifically used to disgrace a person for their race, religion, or sexual habits. There is now a controversy if hate speech should be regulated on college campuses or not. I have read a few articles with the author being either for or against regulating hate speech. My opinion is that yes, we should regulate hate speech on college campuses.
