Unjust Jim Crow Laws

1. Jim Crow was a set of laws enforcing racial segregation in the southern United States from 1877 to the 1960’s. These barbaric and corrupt laws were set mainly against African Americans, limiting their human rights such as voting. The Whites firmly believed they were the superior race over African Americans because they labeled themselves as being more intelligent and civilized.

The Jim Crow laws were state and local laws enacted that mandated racial segregation in all public facilities in southern states of the former confederacy. The blacks were said to be “separate but equal” and this separation led to conditions for the blacks that tended to be inferior to those provided for whites. Law-enforced segregation mainly applied to the southern United States whereas northern segregation had patterns of segregation in housing that was enforced by the covenants, bank lending practices, and job discrimination. For decades, this included discriminatory union practices for decades. The Jim Crow laws segregated public schools, public places, public transportation, restrooms, restaurants, and drinking fountains. Therefore, it did nothing to bring about social or economic equality.

Jim Crow laws were a set of laws that separated non-colored people from colored people. I feel that these set of laws are very cruel. In this writing prompt i will be talking about the few ways that shows Jim Crow laws separate white from black.

Another cause of the conflict Jim Crow Laws, was that many white southerners didn’t believe African Americans should have equal rights as them, which then leaded to segregation in public places. Many public places were labeled with signs above them that said, “Colored Only” or “White Only.” An article I read had said, “Jim Crow Laws extended to restaurants, hotels, theaters, bus stations, parks, public restrooms, drinking fountains, public schools, and the United States Military.” Meanwhile in buses, many black people had to sit in the back of buses, use different water fountains, and different restrooms as well. Mass incarceration is known as a net of laws, policies, and rules that equates to the American criminal justice system. This series of principles of our legal system works as an entrance to a lifelong position of lower status, with no hope of advancement. Mass incarceration follows those who are released from prison through exclusion and legalized discrimination, hidden within America. The New Jim Crow is a modernized version of the original Jim Crow Laws. It is a modern racial caste system designed to keep American black men and minorities oppressed with laws and regulations by incarceration. The system of mass incarceration is the “new Jim Crow” due to the way the U.S. criminal justice system uses the “War on Drugs” as the main means of allowing discrimination and repression. America currently holds the highest rate of incarceration in the world, and even more African American men imprisoned, although white men are more likely to commit drug crimes but not get arrested. The primary targets of the criminal justice system are men of color. Mass incarceration is a rigid, complex system of racial control that resembles Jim Crow.

Jim Crow Laws were mainly found in the southern states of the the US, but could also sometimes be found in northern states. These laws were created around the time the 14th amendment was created in which all races had the right to vote. Jim Crow Laws were meant to limit the freedom of Africans-American. These laws included,”A black male could not offer his hand to a white man” and that blacks and whites were not suppose to eat together. An African-American couldn’t even look in the direction of a white person without being punished.

Jim Crow laws dominated every aspect of African American life from its inception after Reconstruction up to the civil rights era and its affects can still be felt today. During this era of Jim Crow African Americans had different ways of coping with these oppressive laws. These ways of coping included these three methods, migration, agitation and accommodation. Out of these three methods the most effective at defying Jim Crow laws and fighting segregation was agitation.

The Fifteenth Amendment granted black men to vote. Put emphasis on men because at this time women still couldn't vote.This amendment would not be fully followed until almost a century. What the government did was that they made a literacy test so difficult that no slave could pass because they had no education. So no blacks could vote really for a long time. So to loop their loophole that made a rule called the Grandfather Clause. This made if your grandfather could vote you did not have to take the literacy test. So every white person's grandfather could vote since they lived in england. So this rule did not apply to blacks since their grandfathers were black and could not vote. After the Civil War, most Southern and Border States deprived the basic rights of African Americans. Jim Crow was a fictitious character created by a white entertainer to ridicule African Americans. The laws were made in an attempt to keep African Americans away from whites after slavery ended (“Examples of Jim Crow”). The Jim Crow laws affected education, health care, and social events. “From Delaware to California, and from North Dakota to Texas, many states (and cities, too) could impose legal punishments on people for consorting with members of another race” (“Jim Crow Laws”). These punishments could be brutal or sometimes fatal.

However, the Grandfather Clauses that were introduced allowed men who did not pass the literacy test to vote on if their father or grandfather had been able to vote before the reconstruction. African Americans were not allowed to vote until 1867. The Jim Crow Laws however chose to further restrict the Blacks by adding etiquette laws. Almost all of society believed that the Whites were better then the Blacks in all ways, including intelligence, being civil and having morals. It was believed by the Whites that sexual relations between races would cause a mongrel race to be born therefore in return destroying America .

“Jim Crow Laws were statutes and ordinances established between 1874 and 1975 to separate the white and black races in the American South. In theory, it was to create "separate but equal" treatment, but in practice Jim Crow Laws condemned black citizens to inferior treatment and facilities.” The Jim Crows Laws created tensions and disrespect towards blacks from whites. These laws separated blacks and whites from each other and shows how race determines how an individual is treated. The Jim Crow laws are laws that are targeted towards black people. These laws determine how an individual is treated by limiting their education, having specific places where blacks and whites could or could not go, and the punishments for the “crime”

According to the thirteenth, fourteenth and fifteenth amendments, blacks had the same legal protection as whites. The Supreme Court contradicted this when they allowed so called “restrictions” in the South against blacks. Those who supported Jim Crow generally lived in the South. They believed that whites were above the blacks, in things ranging from intelligence to morality. They thought sexual relations between the two races would ruin the nation, and violence could be used on blacks if needed. So, hospitals, beaches, parks, prisons, public restrooms and even water fountains were separated by color of skin. In certain areas, there weren’t even facilities for colored people (Pilgrim). African Americans also had to treat whites with respect, whereas whites did not have to, and most of the time would not treat the blacks the same. Blacks had to use titles when speaking to whites, they could not eat with the whites, and black men could not offer to shake a white mans hand. Preachers did not help with the problem, but in some situations made it worse. They would preach that God supported segregation, “the whites were the chosen people, and Blacks were servants” (Pilgrim).

Jim Crow Laws acted as a synthesis of social hatred and legality: they allowed white supremacists to dictate the lives of African Americans through the law.

The Jim Crow laws perpetuated segregation. This set of rules to show the dominance of the white race were absolutely appalling. They were mainly operated in the southern portion of the United States, but not exclusively. The Jim Crow laws “were in place from the late 1870’s until the civil rights movement began in the 1950’s” (“Jim Crow Laws”). Blacks and whites could not use the same drinking fountains, restrooms, or attend the same restaurants, churches, and schools. It was considered rape or an unwanted advance for a black man to offer his hand to a white woman. Another law was that african-american couples could not show affection towards each other in a public area because it “offended whites” (Pilgrim) along with countless more. There

The overall way race was handled, specifically, the Jim Crow laws were wrong because of the idea that it was okay to be separate but equal. Black people were allowed to vote, attend school, and were basically offered all of the same opportunities as a White person...right? Wrong. This might have been true if you were African American and lived in Union (Northern) states, but in the Confederate (Southern) states, African Americans were not treated the same. In the south, Black and White people were separate, but in no way equal.
