Articles of Confederation versus Constitution Essay

Towards the end of the Revolutionary War, the people felt they needed a document to secure their independence from Britain. This document was the Articles of Confederation. Shortly after that, a new document was formed to what we know as the Constitution of the United States. These documents were similar but more different at the same time with each other, and each granted specific powers to the national government.

The Articles of Confederation and the Constitution are two different types of Government. There are many differences between the two, for example, the Articles of Confederation were made for the original 13 colonies. The constitution was made for the United States of America.

Mainly because these guidelines limited, or expanded the powers of the executive, legislative, and judicial branch. The Articles of Confederation was the first constitution of the United States. They were written during the revolutionary war to create a more unified government, and to establish what the national government could and could not do. The Articles let each state keep “sovereignty, freedom, and independence,” and created a very weak central government. For example, Congress could not regulate commerce or impose taxes. The impact that the Articles of Confederation had on federalism for the next few years was: the federal government had very few powers, and most of the authority remained in control of each individual state.

For instance, they were both written with the same intentions of creating new country of freedom for many people. It also contains the same ideals of government that the Articles had, just in a different format. Also, both central governments had the right to raise an army and build up a navy. However, this seems to be where more differences start to appear. One glaring difference between the two is that the Articles made the states seem like a friendly cooperation while the Constitution firmly defined the unity of the states. Also, the Constitution resolved the problems that the central government had when referring to levying taxes and controlling trade. Another importance between the two is the number of Congress votes each state had. During the time of the Articles of Confederation, there was only one congressional vote per state. On the other hand, after the Constitution was put in place, each state had one vote per delegate elected into Congress. The Articles were very weak and instable; they were not capable of keeping the country together for very long. The Articles for example were Unicameral, while the Constitution was bicameral. It was just not as strong as the Constitution. The Article did not even have an Executive Branch. United States would definitely not have come to its position it’s in today with the Articles of Confederations. Just look at their way of entering states to the Union, they have to get all of the 9 states to agree on entering it. But that’s not the hard part, the hard part is imagining having to get this news across to every state, it would be a very long Process. The Articles of Confederation, which was considered the first constitution of the United States of America, and the US Constitution, which acts as the supreme law in the United States today, both are poles apart. In fact, it was only because of the weaknesses of the Articles that the present-day US Constitution was drafted. The Articles of Confederation or Articles was a written agreement which laid the guidelines for the functioning of the national government. Although the articles set the United States free, it was unable to provide them with a solid government. Leaders like John Jay and James Madison criticized the Articles of Confederation because of the weak government. (Doc G) There were several problems between the states and the central government. For instance, sometimes the states refused to give the government the money it needed, and they engaged in tariff wars with one another, bringing interstate trading to a halt. The government could not pay off the debts it had incurred during the revolution, including paying soldiers who had fought in the war and citizens who had provided supplies to the cause.
