On October 10, 2015, while working off duty at Cardinal Health, reserved Deputy Brawley and Sergeant JakeBowden were advised by an employee that a wrecker was circling the lot. It is Cardinal Health’s policy not to allow people on the property unless they have business with or are employed by Cardinal Health. The parking lot is posted.
Deputy Brawley went to make contact with the subject and Sgt. Bowden watched in case there were problems. Brawley made contact with a white male (later identified as Jason Taylor) and a white female in a wrecker. After making contact with Deputy Brawley the truck continued through the lot.

Bowden advised Taylor that the lot was private property and he had to leave. Taylor refused Sgt. Bowden’s lawful order and stated that Sgt. Bowden did not have arrest authority when he was not on duty. Taylor stated that he had a voluntary repossesion order that gave him the right to come on private property. Sgt. Bowden noted what appeared to be a computer printout that was the order Taylor was talking about. The print out was not consistent with any court order in Sgt. Bowden's experience. Sgt. Bowden asked if it was and order from a judge. Taylor avoided answering but finally admitted it was not.
The contact continued for some time with Sgt. Bowden repeatedly telling Taylor he was trespassing on private property. Taylor stated he used to be a police officer in Texas, he knew the law, he was not trespassing and that Sgt. Bowden had no legal authority. Sgt. Bowden explained to him he had arrest authority at all times while he was in Pulaski County. Sgt. Bowden advised he was in Pulaski County and identified himself repeatedly by name, rank and agency both verbally and by ID and Badge. While doing a High Visibility Deterrant in lot #25, we were requested to assist WPD at 1712 hours by WPD Scat 248D Jared M Henry #2271. WSU Officer Dickerson #155 contacted WSU Sergeant Brad Agnew #153 by radio to confirm if he heard WPD's request for WSU officer. WSU Sergeant Brad Agnew #153 confirmed and told Officer Dickerson and I to switch over. Officer Dickerson confirmed WSU Sergeant Brad Agnew's traffic and radioed WSU dispatch to inform we would be switching to the WPD North channel. WSU Sergeant Brad Agnew #153 then informed us to not get involved and to switch our radioes to the Letac 10 channel and we did so. Officer Dickerson #155 then informed Letac 10 dispatch that we (WSU 202) would be assisting.
On 08/20/2017 at 1002 hours FTO Wheeler #4361 and I responded to St. Luke’s Hospital emergency room entrance, on 3555 Cesar Chavez St., regarding a women in a hospital gown trying to break the caller’s vehicle window with a brick. Officer Wheeler and I were in full police uniform driving a marked patrol unit when we responded.
I notified dispatch that Officer Albert and I were out at the RSC. I parked our patrol car on the north side of the RSC and entered the north door. I heard Officer Smith on the radio say he was out with the subject near the Credit Union. I observed from across the RSC Officer J. Smith and Officer R. Faison standing next to a black male all the way by the Book Store. As I walked closer, I could see the black male with both of his hands up in the air and he was getting down on both of his knees. On July 04 2017, at approximately 6:34PM I, Sgt. Bowring was investigating criminal mischief that had taken place at Lake Holbrook near the point. While myself and Deputy George where speaking to two individuals possibly involved in the criminal mischief an unknown female advised Deputy George that there was a fight in the Men’s Restroom that was located approximately 20 yrds away from our location.
This officer approached the vehicle and contacted the driver and lone occupant identified as Renee Gamez via an Indiana Driver’s License. This officer advised Gamez the reason she was stopped and asked if there was a reason for her speed.
On Friday, August 07, 2015, at approximately 1304, I had just called my dispatch center to let them know I was on duty and dispatch advised they had just aired, over the police radio, an officer safety BOLO (Be on the lookout) for a male party, identified as James Michael Leigh, who currently had a warrant for his arrest, out of Durango Colorado, for homicide. According to Dispatch, James was heading north and his cell phone had been pinged just south of Ouray. I asked MD what her mother’s name was and she told me it was Becky Deskin. I asked for a phone number to reach her mother and MD provided it to me. I returned to my patrol vehicle and contacted Becky and informed her of what was going on. While I was on the phone with Becky, Cpl. Dustin had MD step out of the vehicle to perform field sobriety evaluations. I gave Becky my location so she could come pick MD up.

On 10/25/17 at 6:58 AM, Security Account Manager Enmanuel Cabrera was notified by the Inbound Shack that there was a truck driver that did not want to leave the property. Immediately, A/M Cabrera made his way to the enter shack. Upon arrival, A/M Cabrera met with Yard Specialist Lakwinder Singh and Dan Balan. The Yard specialist explained that the truck driver’s load was canceled and was asked to leave off the property. Officer Esposito proceeded out of the GM exit with Edwards and we both observed the subject riding his bicycle through the Walmart parking lot. The subject was traveling in the direction of McDonald's. Edwards was advised to contact dispatch to report the fraud while I proceeded to McDonald's in my patrol vehicle.

Mr. Alexander was interviewed on scene by Sgt. Hentosz. That interview was recorded and is included in this investigative packet. Mr. Alexander stated he was at the bank but could not get a question answered. The manager left and then the officer showed up and the officer told him he needed to ask him to leave. Mr. Alexander said he would leave but wanted to have his question answered first. The officer told him he was trespassing now. Mr. Alexander eventually agreed to leave but wanted the officer’s name and badge number. The officer said fine and then Mr. Alexander said he grabbed a pen and a piece of paper off of the bank desk. He said the officer then grabbed him up and embarrassed him in front of all these people. He said the officer had his wrist so tight up against his back he felt it could break. They then went outside and the officer “asked me to sit down and I said you just asked me to leave what do you want me to sit down for?” The officer then threw him on the ground and his phone broke. On the morning of August 18, 2013, Petitioner had attached a GoPro on his surfboard before going to the beach with his two friends. (R. at 3). Later that afternoon, Petitioner and his two friends were subject to a traffic stop by Sergeant Cagney and Officer Lacey. (R. at 9). Sergeant Cagney had been alerted of a string of residential break-ins and believed that the three young men fit the description of the three break-in suspects. (R. at 9). In addition, Officer Lacey noticed Petitioner’s friend’s bicycle did not appear to be in compliance with the New Motor Vehicle Code. (R. at 9). Since they were potential suspects, Cagney questioned them concerning their activities that morning. (R. at 13).
