Labor Unions: Changing Government Legislation

A union is an organization of workers who join together in order to have a voice in improving their jobs and the quality of work within the organization. In many occasions, unions help employees of an organization negotiate pay, benefits, flexible hours and other work conditions that may arise. Unions have a role because some degree of conflict is inevitable between workers and management (Noe, 2003). In this paper, I will be discussing the impact of unions and labor relations within an organization.

“I regard my workpeople just as I regard my machinery...When my machines get old and useless, I reject them and get new, and these people are part of my machinery” (Sands 12). A foreman at a textile mill in Fall River, Massachusetts spoke these words in possibly the worst time during American labor history, the Industrial Revolution. During the Industrial Revolution, large numbers of people in the United States flocked to work in factories where they faced long hours, unsanitary and unsafe conditions and poor wages. The changes brought up labor unions in the United States over recent history has brought about a movement. This specific movement has shaped the way that employees and workers are treated in the workforce,and how they maintain their quality of life through this employment. Many people think that the labor unions’ influence has created a power struggle between management and union leaders. In many cases this can be considered true, as there have been countless feuds between management teams and labor unions, especially in recent history. In today’s times, on the one hand, some people believe the existence of unions are a necessity in order to ensure and promote employee freedom; while on the other hand some people view labor unions as just another problem in the line of employee success.

Organized labor affects the lives of many citizens everyday, often in a roundabout way. Labor Unions affect many different people from blue-collar workers to white-collar workers, stay-at-home moms, students, and retirees. Fewer; however realize the legal role Labor Unions have played and continue to play in the financial system, political affairs, and society in general. In today's society, more of our skilled hourly and unskilled workers belong to some sort of Labor Union and that is a good sign that Unions will not face extinction. As long as there is a need for higher wages, there will be a need for Unions.

Labor union is an organized association of workers, in a trade or profession, formed to protect and further their rights and interests. During the industrial revolution in Europe there was a rise in new workers without representation in the workplace. In the 19th century the industrial revolution spread to the United States from Europe, this resulted in the economy shifting to manufacturing from agriculture as an economic importance. American societies were increasing in population as well as experiencing industrial growth. The fact that many US employers look down on, discourage, and blatantly combat unionization is not a recent occurrence as successful organization thereof can result in decreased profits and inflated personnel costs. Fossum (2012) argues that ‘employers have long resisted attempts to unionize” (p. 215) and implemented various strategies to remain union free and greedily persist in their efforts toward heightened profitability through utilization of unfair labor practices.

The labor union movement over the years has shaped the way individuals work and live for both the nicest and unpleasant. Some would think the unions influence has created a power struggle between management and union leaders. Employers initially resisted unions as they were seen as a ‘tool of worker power’, and some countries even banned the groups all together (Baoill 2011). Although these restraints have been lifted, restrictions and guidelines have been put in place by government bodies to govern union activity; and employees internationally have the right to form unions (Baoill 2011).

Individuals have been at work for thousands and thousands of years. Over the last century there have been many changes in the United States that protects workers in their positions and the duties they perform. There has been many changes for employers as well that protects companies and organization and offers beneficial information to keep them in compliance with changes and away from any from and form of discrimination. Labor Unions have become an important factor in our industries. For many years, labor unions have served as the main voice of the workers to their employers. The continuous effort of labor unions in helping the laborers ensure their rights in their jobs, acquire all the benefits they need and to eliminate the injustice experienced by workers in their workplace is still an ongoing process. In order to understand labor unions in general, knowing the roots of it is the best way to start. In this paper, the progress of the labor unions throughout history, the issues faced the developments it achieved, laws passed and the problem faced by today’s unions will be tackled.

David Brody argues that the rise of contractual or collective bargaining relationships during the post WWII era formalized the relationship between employers and unions. The use of collective bargaining agreements to resolve workplace disputes weakened unions and the power of workers. Other actions, such as using collection bargaining as a form of substitution for direct action and using it instead of the strike for grievance and arbitration procedure served , also has weakened the unions and the power of workers.
