Police Brutality And The Police

There is no question that police brutality, when it occurs, is one of the most egregious violations of public trust that a public servant can commit. Police officers, those individuals taxed with protecting the public from danger, should never be in a situation where they pose a threat to the public. Furthermore, there is no question that police brutality occurs. Moreover, generally when there are allegations of police brutality, there has been some type of underlying violent incident. In addition, while issues of brutality may seem clear-cut to a disinterested observer, it is critical to keep in mind that law enforcement officers are not presented with textbook examples of the appropriate or inappropriate use of force, but real-life scenarios involving quick decisions. There are many arrest and non-arrest scenarios where officers need to use force to protect self or others; and the degree of force required may be greater than what a disinterested observer would assume. Another recurrent issue in debates about police brutality is that racial bias appears to be a motive behind police brutality. When one considers that minorities are disproportionately likely to be arrested and convicted of crimes, one would expect to find a disproportionate number of minorities among those alleging police brutality. The brutality of the police force has been a long worldwide problem, but especially between the years of 2012-2016. Black people are being unjustly beaten and shot in plain sight for doing nothing while being unarmed. Journal of African American Studies “Blacks are viewed as deserving of harsh treatment in the criminal justice system” (482). “Black males with more “Afrocentric” features may receive longer sentences than blacks with less Afrocentric features like lighter skin and straighter hair”(482). Nowadays it is important to know about the police force. It’s important to know our rights as citizens and be careful around cops. Not everybody is good, but not everybody is bad also. In The New York Amsterdam News 21 people were killed by Chicago police in 2008. Entire families were being attacked. They believe it’s because of their skin color and how they are different. The year of racism started off with the world seeing the police murder of Oscar Grant. “The media have pushed people away from hearing the issue of police brutality, and it has fallen off of the radar screen.”(2) “You can’t give in. They will try to make an example out of you, try to break your spirit!”(2) African Americans say do not trust the cops with anything. “They will ruin you.”(2)

Police brutality is seen as a real problem in America today. What people do not seem to realize is that the police carry a massive burden each day. The work that officers do has the potential to be very demanding and sometimes involves dangerous situations. In these situations the officers are in the position where they may be required to use force to gain control. The continuum of force dictates the level that is most appropriate for the situation. Most people do not realize that is not the officers job the meet the force. However, it is their job to overcome the force. Police departments have very strict standard operating procedures about officer use force and how force is applied. With this paper, I will attempt to explain the continuum of force, police discretion, and why the police can do some of the things they do.

When Ferguson, Missouri exploded after the police shot an unarmed black teenager, the tension between the community and its protectors was laid bare. Ferguson is not the first and certainly not the last community forced to bridge that chasm. In South Carolina a policeman shot an unarmed black male who was stopped for a seat belt violation. The cop asked the male for ID, who then reached under his seat to retrieve his wallet, but was shot in the leg by the cop before he could take out his ID. When the body cam video was reviewed it shows that the trigger happy cop probably was in fear of his life, however it is also obvious that the cop shouldn’t have felt threaten as the behavior of the black male involved nothing unusual. Many would say if the driver was white the cop would have not reacted the way he did.

In recent years and in light of recent tragedies, police actions, specifically police brutality, has come into view of a large, public and rather critical eye. The power to take life rests in the final stage of the criminal justice system. However, the controversy lies where due process does not. While the use of deadly force is defined and limited by departmental policies, it remains an act guided chiefly by the judgment of individual officers in pressure situations. (Goldkamp 1976, 169). Many current studies have emphasized the racial disparities in minority deaths, primarily black Americans, killed by police through means of deadly force. The history of occurrences reveals the forlorn truth that police reforms only receive attention in wake of highly publicized episodes of police misconduct. The notorious 1992 Los Angeles riots brought the matter to mass public attention and prompted improved law enforcement policy. Significant local reforms resulted, for instance, ending the policy of lifetime terms for police chiefs. Additionally, on a broader platform, in 1994, Congress approved provisions to the Crime Control Act in effort to tackle police abuse in a more structured way.

Chapter 4 in The Color of Justice: Race, ethnicity, and crime in America, was about the relations between society and law enforcement officers. This has been a major topic, especially in the United States for a long time. The unfortunate statistic that minorities are more likely to encounter being killed, arrested, and victimized by excessive physical force; has been a real issue even in today’s society. However, police departments are trying to combat the way police officers interact with the community; especially those of color. Although steps have been takes there are still some instances where police aggression happens. Throughout the last one hundred and fifty years, there has been a history of tension and conflict between the police and minority communities in the United States. In principle, the police exist to enforce the law and protect all citizens regardless of race or ethnic background, yet police departments across the country have been repeatedly accused of targeting and harassing racial minorities, and of failing to root out racist attitudes and practices within their ranks. In recent years, high profile cases such as the beating of Rodney King in Los Angles and the assault on Abner Louima in New York have only served to heighten concerns over the mistreatment of minorities by the police, resulting in widespread calls for major legal and institutional reforms. The recent shootings of Michael Brown, Ezell Ford, Eric Garner, and Terrance Crutcher underscore the danger Black men and boys face when they cross paths with law enforcement officers. In the absence of a coordinated national strategy, state and local police departments have largely been left to develop their own solutions to the problems of policing minority communities and improving cultural sensitivity amongst their officers. Many departments have sought to reform recruitment and selection policies in the hope of attracting greater numbers of minority applicants, while others have instituted diversity training and education programs aimed at improving police understanding of minority cultures and communities. To date, however, these efforts have yielded mixed results. Some departments have achieved notable successes, but on the whole, relations between the police and minority communities across the country remain strained. of cultural diversity and the police.

There is recent controversy over police use of force, especially in minority communities such as in African American communities, Hispanic communities, and other publics with large populations of minorities. Increased levels of force among these communities have created challenges for police departments. These challenges include a lack of trust from the community towards law enforcement officers and an absence of respect creating situations that lead to police use of force. There are already various programs in place that attempt to decrease this challenge by educating the public, respecting one another, and giving those who were on the wrong track second chances. A combination of these solutions and the implementation of more of them would decrease the number of contacts between police and minorities that lead to the use of force (Roberg & Novak, 2014).

Within the past year, law enforcement officers across the nation have come under intense scrutiny for police encounters that have resulted in the use of force and police involved shootings. Every time a person of color is killed by a police officer, the media broadcasts the shooting nationwide, inciting hate, anger and racism. Nothing productive is achieved when the media focuses on officers killing people of color. Instead, trust, faith and respect is lost from the public, and law enforcement officers are feared. People fear that when they encounter the police, they will be shot because of who they are. Sadly, all officers across the nation deal with the harsh scrutiny that has resulted from the actions of few. Majority of officers are good, hard working individuals who would put their life on the line to save and protect human life. Yet, on a daily basis, officers across the nation are disrespected and hated, simply for the job they do and who they represent. Despite recent events, police brutality is not an issue; law enforcement officers are still deserving of the public’s trust and this trust can be rectified with the understanding of use of force, increased community policing and continued use of force training for officers.

A young man’s brutal death at the hands of the police is found justified in a court of law due to his “suspicious” appearance: a black hoodie and his hands in his pocket. An elderly woman is fatally shot in her home for her relation to a suspected criminal. A married man with two toddlers is choked to death after a minor traffic stop by an officer who later claimed that his unarmed victim was wielding a gun. These people all have a few commonalities: the color of their skin, their presumed guilt at first sight, and their ultimate unjustified death administered by the law force. These are not uncommon occurrences. Due to the staggeringly disproportionate rate of African-Americans killed by the police, and the underlying rampant racial profiling, police brutality towards blacks in America must be called to light.

A great deal of society views law enforcement officers as heroic and honorable individuals, whose main purpose is to protect and serve the community. For many officers, this description is accurate, however for others; violence and brutality against innocent citizens is part of getting the job done. For years, minorities have fallen victim to police brutality based on racial profiling, stereotypes and other

Police-citizen violence and related concerns are prime topics of conversation wherever law enforcement professionals gather to discuss problems. Many police departments have made reviewing their use of force a top priority. And major civil rights organizations have made a priority of responding to police use of deadly force. When a law enforcement agency practices racial profiling, it gives the wrong impression that whites are considered to be law abiding citizens while blacks and Latinos are considered to be criminals. Racial profiling policies set up law enforcement agencies as enemies of communities that they serve. Unlike racial profiling, community policing has consistently been shown to work. The better the relationship between residents and police, the more likely residents are to report crimes, come forward as witnesses, and otherwise cooperate in police

I have been a police officer for nearly 10 years, and I have seen how the citizens we serve and the various media sources that surround us constantly scrutinize our actions. Simply because the actions of other officers may not be ethical, professional, or correct in the eyes of society, that should not determine the hatred towards all of the officers. Often people believe that police officers constantly and consciously commit racial profiling, but that is not the case. Chapter Four: Racial Profiling and the Law will be utilized to demonstrate the legal issues surrounding racial profiling that have led to changes in law enforcement.

Police brutality is not a new subject. It has been around for numerous years, and like most issues, has resurfaced to the public’s eyes. The recent events brought up the question: Does there need to be a reform in the system in the police system? In this year alone, there have been countless cases of individuals being harmed or even killed by police officers for reasons that continuously are not explained. What has people more attentive to this injustice are statistics showing that most victims in these police attacks happen to be African Americans and other minorities.
