Contract Negotiations Contract Negotiations Negotiations are something that everyone experiences and does at some level. Even if informal, people negotiate and barter using what they have to offer to get what they want all of the time. However, there are times in life where the negotiations are much more serious and the stakes a lot higher. Whether official or unofficial, there are negotiation tactics and conditions that should be watched out for because they are a sign of potential problems. Bad Faith & Fraud This one sounds like an easy one to remember and watch out for but some negotiators of contracts are not scrupulous or honest. As such, any wise person entering contract negotiations needs to enter the fray prepared. Smart negotiators are always on the lookout for anything fishy. If it looks too good to be true it quite possibly is and before affixing a name to a contract, it needs to be verified as much as is reasonable or possible to ensure that what is being promised will be delivered. For example, buying a car without a trusted mechanic inspecting the car for obvious signs of problems is not smart and this is true of any other potential negotiation as well (Layng, 2009). Too Easy a Concession In a lot of negotiations, it is generally expected that the two parties will stand in two different camps in terms of price or other conditions and that both parties will meet somewhere in the middle.
