Solving the Issue of Fellow Officers Abusing Their Power and Sometimes Taking the Law into Their Own Hands

Police brutality and office involved shootings have sparked national debate and created a strain between police officers and citizens. Recently, there have been more home videos that display acts of aggression by police officers. These police officers often use excessive forces or a condescending tone towards people of color which is why there needs to be a better way to mend police and civilian relationship. People should be able to trust the police in their communities rather than fear them.

Police officers are faced each day with a variety of situation in which they must deal; therefore we should ask ourselves the following questions: Should police officers enforce the law equally in all situations? In what situations should police officers be allowed to not enforce the law? What types of situations would they be required to fully enforce the law? Why does police discretion exist? What are its strengths and weaknesses? And what is the relationship between police discretion and police ethics?

In dealing largely with disorderly elements of the society, some people working in law enforcement may gradually develop an attitude or sense of authority over society, particularly under traditional reaction-based policing models; in some cases the police believe that they are above the law. In other cases, police corruption and misconduct may be explained by individuals and individual faults- behavioral, psychological, background factors, and so on.

The media has scrutinized the use of force even more recently. Recordings of officers using force (weather excessive or not) become uploaded to the web and many individuals quickly jump to conclusions. Police use of “force” is up to the discretion of each individual police officer, and with each action a multitude of consequences can occur. The public often gets enraged after a court justifies the use of force, but often individuals do not have the full facts or understand how the justice system works. The outcomes of some use of force cases, many individuals are asking for transparency of agencies. Policy makers are often quick to react to satisfy the public by changing police policy.

In this essay a discussion will be explored about the benefits and problems associated with police use of discretion. Which current policing strategies have the most potential for controlling officer discretion and providing accountability, and which have the least, and why is that the case? And finally, how might these issues impact the various concerns facing law enforcement today?

Lack of training and policing standards are closely linked to the myriad problems bedeviling police work, especially in small departments (Brodeur, 2010). All over the country, police departments report cases of officers being caught in uncompromising and unprofessional situations, resulting in disciplinary actions such as redeployment, suspension or sacking. These cases of unprofessionalism have led to questions being asked about policing, occasioned by recurring series of questionable and controversial encounters with police officers (Brodeur, 2010). The consequence of such encounters is increasing public distrust in law enforcement agencies.

Because of exceptional results akin to those of the Rialto study, Birmingham police Chief, A.C. Roper plans to equip every officer in Birmingham with a body camera. Since the behavior of the police are so much better, there will be more diversity within the police force. Therefore, the police force’s public image would alleviate, and more people would be willing to join the police force. Diversity will increase the placement of trust in the police force. Diversity will allow the agency to converse more effectively with minority communities. Police executives have always had different issues within the police department. Most police executives try to find a quick fix in order to solve the issue of police misconduct. Police misconduct is defined as inappropriate action taken by police officers in relation with their official duties (Police Misconduct Law & Legal Definition, n.d.). In order to solve this issue, one must acknowledge their different challenges, overcome the “code of silence”, and find out the role of organizational culture.

When debating the issue of police use of force, the issue of what actions constitute too much force must also be addressed. Another concern is the possibility of corruption amount officers. When given such great power, the probability of corruption is high. Officers generally do not start out as corrupt, but years of work on the force can create animosity between officers and suspects and lead them to decide to use force more quickly (McEwen, 1996). Many times, officers patrol the streets alone which creates the opportunity for potential abuse of power (McEwen, 1996). Although police officers need to be permitted to exercise some discretion, they also need limits and guidelines to follow when using their powers of discretion (Manning, 1997). The decision to use force should not be taken lightly in that citizen’s lives are at stake. Police should be allowed discretion in decisions to use force; however, this discretion should be limited. When this loyalty to the subculture becomes too strong, the unity that follows can adversely affect the ethical values of the officers (Martin 2011). This type of work environment causes officers to feel like they are doing what is wanted by their organizations and the public and the officers may continue with the behavior because the pressure to produce results is greater than that to follow the rules. A law enforcement department might choose to punish an individual, but the fear of punishment usually is not enough to change unwanted behavior (Martin 2011).
