What Groups Are Likely To Develop? What Changes In Immigration Laws Might We See?

Immigration is one of the contentious issues that continue to elicit mixed reactions from different parties. In most western economies, debates on immigration policies have been on the rise in the recent decades. Whereas the international human rights have confirmed that freedom of movement is one of the basic human rights and hence no one can be deprived, most governments have put restrictions on immigration. Furthermore, the enactment of open immigration policies in various countries continues to raise mixed reactions with proponents and critics of the policies contributing to the debate. Immigration policies usually vary from country to country and within states with both, either opting for open or closed immigration policies. The impacts of illegal immigration and open border policies have been central to the above debate. This paper explores the issue of open border policies and illegal immigration and its inherent dangers.

Immigration issues have been a problem throughout history. This Society holds different perceptions on the topic. Some people favor the flow of immigrants while others oppose it. Immigration is a social problem that must constantly be reviewed due to the complexity of the problems. In this situation, different factors such as the quality of life for immigrants, how they impact the economy, how the implementation of policies would benefit them, have to be taken into consideration. Immigration policies affect all aspects of today’s society. The key figures in the immigration issue are immigrants, documented/undocumented, political figures.

Immigration involves the movement of a group of people from one country to another where they do not possess citizenship. There are many reasons in which people may leave their country such as employment, lack of resources, family, fear due to violence, exile, the American dream. In 1965, Congress changed immigration law in ways that allowed much more intake from Asia and Latin America than earlier. Before 1965, the intake was mostly from Europe. Since then, over half has come from Latin America—28 % just from Mexico. The share of population composed of non-Hispanic whites plunged from 84 % in 1965 to only 62 % in 2015 while Hispanics soared from 4 to 18 %. (Mead, L.M., 2016)

Immigration has become a very relevant topic in the past few years and has sparked various arguments between Americans. No agreement has been reached regarding immigration reform, possibly because many people view it as an immediate amnesty rather than a possibility of legalization for hard-working immigrants. Despite of the negative meaning associated with it, an immigration reform would be beneficial to the U.S. in social aspects, such as having undivided families, and by stimulating economic growth.

In the United States, immigration has been high topic of debate. As of 2015, 13.5 percent of the United States population of 321.4 billion were immigrants (Jie). Immigration has been shaping the way America works for many years now. It has brought changes to the economy, workforce, culture, language and politics just to name a few changes. America is often referred to as the melting pot of cultures. Where the “American dream” can be reached as long as you are willing to work hard. However, citizens also demand strict boarders to prevent illegal workers but we still want the free movement of goods. A lot of legislative bills have been past in recent years that have brought change to immigration and the way it is done. The top five bills that have affected the country are as follows; The Immigration Reform and Control Act, IRCA, of 1986 penalized employees for hiring unauthorized workers. However, did nothing towards changing the immigration system or provide resources to implement the employer sanctions provisions. The Immigration Act of 1990 overhauled the immigration system by raising the number of permanent vistas form 290,000 to 675,000 and allotted 555,000 visas annually of underserved counties. The Illegal Immigration Reform and Immigrant Responsibly Act, IIRAIRA, of 1996 dealt with government spending and a three or ten year bar on returning to the United States for people who were caught without proper documentations from applying for asylum status within one year

Immigration has a great impact on first generation immigrants. Studies show that acculturation and assimilation have wide-ranging effects on the groups involved, but mostly on the immigrants' lives. There are positive and negative attributes. Attributes that are due to the issues associated with integrating cultures, and broadly related to the greater issue of immigration. One of the most defining traits for the United States of America is that the nation is one made up of immigrants, it is a basic building block that can not be overlooked, nor should it. That being said, it is important to countless citizens to be open when it comes to immigration, while keeping the country hospitable to its citizens for generations to come. However, this attitude to immigration is a fairly recent phenomenon in American history, especially in regards to immigrants coming in from non-Western European countries. With the introduction of the Immigration Act of 1965 and the Immigration Reform and Control Act of 1986 (IRCA) came about the changes to immigration policy that would forever change the face of the nation and create the diversity that has become a point of pride. The sentiment is not felt nationwide, however, as the immigration patterns brought about with these two acts has brought hostility as well, especially from those who feel that immigration is a threat to the country as a whole, specifically illegal immigration. Immigration, and its illegal counterpart, is an issue that defines this period in American history, and while it did not necessary start off targeting Mexican and Latino immigrants, it has very much been immortalized within the communities and become the face of immigrants to the nation as a whole.

The reforming of America?s immigration policy is something that can no longer be avoided and must be dealt with as soon as possible. Years of neglect by governmental agencies and policies makers have now made this issue one of the biggest in American politics. First of it must be understood that immigration does no only effect curtain areas of the country and curtain aspect of public life but rather all of American life. Both legal and illegal immigration affect major issues such as jobs availability for all citizens, wages, education in public schools system and in general, health care issues, and the homeland security.

In this paper, I decided to analyze the immigration policy. The immigration policies have had a deep history. The policies have been twisted, in the long run, to meet the demands of the time. However, most of the times, the policies have been unfair especially in regard to the immigrants. The overview contains a rich history of the policy progression and advancements in the immigration sector. In this paper, I decided to extrapolate on some few contemporary issues that are as a result of the immigration policies and laws. One of the contentious issues is the Visa policy. This is a system that is widely used by the US government. Though formulated with a good purpose, the formulation did not cater for everything that is associated with immigration. For instance, the immigrants who are on transit for employment are not selected based on the employment demand in the market, hence, they end up being stranded and thus are forced to accept low-paying jobs with poor working conditions. The solution to this is also discussed in the paper. I have also discussed on the open door policy and its implications which include overpopulation. Overpopulation on its part has directly affected both the immigrants and natives with many adverse effects. Controlling the borders of the United States and Mexico has always been a dilemma that seeks attention and needs a new, innovative way to reduce the amount of immigrants crossing the border illegally. Many attempts have been made by current presidents as well as previous presidents who have had different views from each other and are still unable to solve the hurdles of controlling the border. Mai Ngai makes the struggle known by stating that the previous attempted laws that have been put in place to solve the problem will end in another failure. She calls them inhumane and hopes to give immigrants a chance for citizenship. Although I Agree with Mae Ngai’s Idea of putting in a system that stresses the principles of flexibility and fairness, however I see faults in her view point of welcoming immigrants to the country to work. On the other hand I do not think that all immigration should be cut off entirely, as that may cause negative effects on the America’s economy. Mai Ngai mentions that the United States’ "One-size-fits all” rule favors northern and western European immigration and is a restriction on densely populated countries like Mexico. If this law were to allow a higher percentage of immigrants to be documented and allowed in the United States, then negative effects would ensue in places near the border like Texas. This paper will examine the problem of Immigration and Immigration Law. I will first discuss what Immigration Law is and how it works, then I will define the number one problem of immigration laws, “illegal immigration” and why it’s so important to follow procedures. It will also address the consequences after violating the laws. Next the paper discusses three policy solutions to the problems of illegal immigration: Legalization of Immigrants, Strengthen Border Security, and Immigration Amnesty. The paper will first explain each policy solution. Then it will analyze the pros and cons, and potential strengths and weakness of each solution. Last this paper will offer some personal observations on the problem of immigration.
