On the above date and time I was conducting a business check on foot of Walmart.
While inside the store, I observed a White female subject in the electronics department of the store. The subject was yelling profanity at a Walmart employee. The subject then yelled "fuck" at the employee twice. Walmart LP Officer, Chris Hoerl, witnessed the disturbance.
I then approached the subject, later identified as Cathleen Ann Williams. I advised Williams not to curse at the employee and I allowed her to continue her conversation with the employee. The conversation was in reference to Williams cell phone being shut off. The employee, later identified as Robert Rice Jr, remained calm and professional during the entire encounter with Williams. Before I could speak, Williams grabbed my clip board and pen. Sgt. Lush had to verbally advise Williams to calm down and to let me explain the situation. Williams was reminded that she could have been criminally charged with disorderly conduct.
I advised Williams that she was now being trespassed from Walmart, located at 8701 U.S. Highway 19 in Port Richey. I further advised Williams that she would be arrested if she returned to the property. Williams acknowledged, and she signed the trespass warning. Before leaving, Williams requested a copy of the trespass warning. Williams again became upset when I advised her that she had to purchased an approved copy of the report at a later date. Before walking away Williams stated "yeah anything so you guys can make money."
I made contact with Hoerl and Rice in the LP office. Hoerl also signed, and received a copy of the trespass warning. Both. I advised Hoerl to contract the Port Richey Police Department if Williams returned to Walmart. Both Hoerl and Williams provided statement form of what occurred.

On the above date and time I responded to Walmart, reference a possible retail theft.
Both Brasch and Stewart were issued trespass warnings per Edwards request. I advised both subjects that they would be arrested if the returned to Walmart, located at 8701 U.S. Highway 19 in Port Richey. Steward acknowledged, and she signed the trespass warning before leaving the scene with Brasch's cell phone (per her request). Brasch later signed the trespass warning at central booking.
The Georgia Shopkeeper’s Defense statute bars the Plaintiff’s suit. The statute bars recovery for false imprisonment by merchants or their agents when all of its elements are met. The Shopkeeper’s Defense statute provides in order to preclude recover the following three elements must be present: (1) reasonable suspicion of shoplifting, (2) reasonable time of detention, and (3) reasonable manner of detention. Ga. Code Ann. § 51-7-60 (2015). The Plaintiff and Defendant have agreed that the Plaintiff’s behavior on September 29, 2015, was sufficient to cause a reasonable person to suspect her of shoplifting, and that the length of the Plaintiff’s detention was reasonable. Therefore, the only element in dispute is the reasonableness of the manner in which the Plaintiff was detained. As such, R-Mart should be protected under the statute and the Plaintiff could only recover for false imprisonment if the facts alleged in the complaint demonstrates the manner was unreasonable.
Upon arrival, I made contact with Walmart Loss Prevention Officers, Fabiano Estrela, and Marion Edwards. The defendant, later identified as Derrick Warren Jordan, was located in the loss prevention office with Estrela and Edwards.
Uliano advised me that the defendant entered the store and concealed several Walmart items in several Walmart plastic bags that she brought into the store with her. The bags were then placed into a Walmart shopping cart.
MUNGIN stated at approximately 1012 hours while working at Walmart store # 1383 in the city of Beaufort, she was called to the Grocery door in the front of the store where a customer was exiting the store without a receipt for two items that was located in the bottom of the shopping cart. On Friday 09/16/2016 at 2300 hours, Security Officer Michelle Gallegos was badging visitors in the E.D. Lobby when the sister of a patient in E.D. # 32 lunged over the counter, knocking down a computer screen and a cup of water, then striking Officer Gallegos in her left arm. Security Officer (SO) Omar Alonso, was inside the E.D. Security Office, and responded immediately verbally instructing the visitor that police were going to be notified and that she needed to leave property immediately, and he also called Dispatch for immediate assistance. The female visitor was with 5 other females and her mother so they all followed Officer Alonso, outside of the E.D. Lobby. They were screaming and hollering that they were being treated disrespectfully by the badging officer who would not let them go back and visit her sister. Security Officers Ariel Weiland, Demetrio Flores, and Supervisor Steven Evans all responded by 2303 hours and helped to keep all 6 visitors outside while SO Alonso, conducted an investigation into the visitor’s allegations that they were being unfairly treated and were given erroneous information. He spoke to the nurse that Officer Gallegos spoke to when she needed information on the patient and permission for visitors to be given a pass to visit. Upon arrival, I made contact with Walmart manager, Kaymarie "Kay" Griffith. Griffith. pointed to two males and stated "I want them trespassed." Griffith stated that the males were with the females as a "watchout." Furthermore, the males tried to purchase merchandise, but their credit card kept declining.
I then made contact with the subject, later identified as Amy Lena Maria Culpepper. Culpepper cooperated and pulled two unpaid Walmart clothing items out of her purse. Culpepper was next led to the LP office due to Edwards requesting a trespass warning.
On 05-24-2017 at 1858 hours I was dispatched to 333 South Westwood Boulevard (Walmart) in reference to stealing.
I recall a time when I went to Walmart to purchase some cloth materials for my daughter’s school project. Once the material was selected, I needed it to be cut. Therefore, since there were no employees in the area, I pressed the button that said “push for assistance”. I waited for 15 minutes, since no one came to assist me, I seeked the assistance of an employee that was passing by. She stated that she will notify someone to assist me and walked away. After 10 minutes had passed, another employee passed by, she asked “do you need help”, I said yes. I informed her that I needed the material cut. Therefore upon reviewing the policy and procedures in the employee handbook, I would terminate Employee 1 and suspend Employee 2 without pay for one week. My reasoning for this decision would stand on the fact of my interviews with the residents and other employees that observed the altercation and the interviewing of Employee 2. Upon reviewing all the information given by everyone and due to the fact that Employee 1 was yelling, using profanities and racial slurs toward Employee 2, I would be able to make a decision. Employee 1 clearly demonstrated a form of discrimination and harassment, which violated the company’s employment policy.
On February 25, 2016, at 8.18 am a MCU member reached Senior Collections representative Brenda Castro and wanted to be service on a current account. Brenda Castro expressed that the Collections department would not be able to services his current account and instructed the member to call customer service. The members stated that he was already transferred from customer service and seem to be getting annoyed with Mrs. Castro and eventually requested to speak to a supervisor. There was a brief hold and Mrs. Brenda Castro returned to provide the supervisor number and the member called Brenda a Sir and the call went to unprofessionalism whereas the member used profanity and Brenda Castro retaliated with profanity. Store 14494, was having ongoing issue with former employee, who was terminated. Former employee would come to the store at early hours of the day, and would cause scenes. The former employee would use profanity and threats, towards the store management team and other employees.
